  1                      A bill to be entitled

  2         An act relating to a limitation on the exercise

  3         of the power of eminent domain; prohibiting,

  4         under certain conditions, a state agency,

  5         political subdivision, or corporation acting on

  6         behalf of a state agency or political

  7         subdivision from taking private property

  8         through the use of eminent domain; providing an

  9         effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  A government entity, in exercising the

14  power of eminent domain otherwise conferred by law, may not

15  take private property for the sole purpose of developing it

16  for the benefit of a private party if no economic benefit is

17  provided to the public. As used in this section, the term

18  "government entity" means a state agency, political

19  subdivision, or private corporation acting on behalf of a

20  state agency or political subdivision.

21         Section 2.  This act shall take effect July 1, 2006.

25    Limits the exercise of the power of eminent domain by a
      state agency, political subdivision, or private
26    corporation acting on behalf of such agency or
      subdivision.  Prohibits taking private property for the
