15 On page 5, lines 3-7, delete those lines
16
17 and insert:
18 (5)(a) Each corporation or other entity that owns five
19 or more motor fuel retail outlets within a single county shall
20 maintain at least one portable generator that is capable of
21 providing an alternate generated power source as required
22 under s. 526.143 (2) for every five motor fuel retail outlets
23 owned. Each such generator must be kept in the state and
24 available for use in the county where the facilities are
25 located within 24 hours after a disaster. If a corporation or
26 other entity owns a number of motor fuel retail outlets within
27 a single county that exceeds five, or a multiple of five, plus
28 three, the entity must own an additional generator for the
29 additional facilities.
30 (b) Notwithstanding (a), corporations or other
31 entities which own five or more motor fuel retail outlets

1 within a single county and own additional motor fuel retail
2 outlets located within the state but outside of the county's
3 domestic security region, as determined pursuant to s.
4 943.0312 (1), which in the aggregate, provide for an adequate
5 supply of generators , as required in subsection (a), to
6 supply the motor fuel retail outlets owned by the entity
7 within the domestic security region after a disaster may
8 maintain a statewide inventory of portable generators which
9 provides for one portable generator for every ten motor fuel
10 retail outlets owned in the state. The generators must be
11 kept in the state and available for use in the affected
12 counties within 24 hours after a disaster.
13 (c) Corporations or other entities which own five or
14 more motor fuel retail outlets within a single county and in
15 the aggregate own a sufficient number of motor fuel retail
16 outlets within the state to provide assistance to other
17 counties to meet the requirements of (a) may maintain a
18 statewide inventory of portable generators which provides for
19 one generator for every ten motor fuel retail outlets owned in
20 the state only if the entity maintains a written document of
21 agreement for reciprocal use of portable generators after a
22 disaster with one or more similarly equipped entities with
23 ownership of a number of motor fuel retail outlets sufficient
24 to meet the requirements in (a) which is located within the
25 state, but outside of the county's domestic security region as
26 determined pursuant to s. 943.0312 (1). The generators must be
27 kept in the state and available for use in the affected
28 counties within 24 hours after a disaster.
29 (d) For purposes of this section, ownership of a motor
30 fuel establishment shall be the owner of record of the fuel
31 storage systems operating at the location, as identified in
