  1                      A bill to be entitled

  2         An act relating to gasoline stations; creating

  3         the "Consumer Emergency Gasoline Act";

  4         requiring that retail gasoline stations be

  5         equipped with an alternative means of power

  6         generation so that the station's fuel pumps may

  7         be operated in the event of a power outage;

  8         providing a period for existing retail gasoline

  9         stations to comply with the act; providing a

10         penalty; providing an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13  

14         Section 1.  Consumer Emergency Gasoline Act.--

15         (1)  Any gasoline station that offers motor fuel for

16  sale at retail to the public must be equipped with an

17  alternative means of power generation on site so that the

18  station's fuel pumps may be operated in the event of a power

19  outage. The alternative means of power generation must be

20  maintained and kept fully operational at all times and the

21  gasoline station must be capable of pumping motor fuel

22  immediately following a loss of power.

23         (2)  Subsection (1) applies to any newly constructed

24  gasoline station for which a certificate of occupancy is

25  issued on or after June 1, 2006. A gasoline station that

26  obtained a certificate of occupancy before June 1, 2006, has

27  until December 1, 2007, to comply with the requirements of

28  subsection (1).

29         (3)  A violation of subsection (1) is a misdemeanor of

30  the second degree, punishable as provided in s. 775.082 or s.

31  775.083.

 4                          SENATE SUMMARY

 5    Creates the "Consumer Emergency Gasoline Act." Requires
      that retail gasoline stations that are issued a
 6    certificate of occupancy on or after June 1, 2006, be
      equipped with an alternative means of power generation so
 7    that the station's fuel pumps may be operated in the
      event of a power outage. Requires that existing retail
 8    gasoline stations comply with the act by December 1,
      2007. Provides a penalty.
