1 A bill to be entitled
2 An act relating to license plates; requiring a
3 driver whose driving privileges are restricted
4 because of a violation related to driving under
5 the influence to have a DUI plate on any
6 vehicle that he or she operates; providing for
7 the Department of Highway Safety and Motor
8 Vehicles to develop such plate; providing a
9 surcharge for the plate; providing for the use
10 of such surcharges; authorizing a law
11 enforcement officer to stop a vehicle bearing
12 such plate without probable cause; providing an
13 effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. The Department of Highway Safety and Motor
18 Vehicles shall develop a DUI license plate that must be
19 displayed on any vehicle that is operated by a person whose
20 driving privileges are restricted pursuant to s. 316.193,
21 Florida Statutes, because of a violation related to driving
22 under the influence of alcoholic beverages or other specified
23 substances.
24 (2) The plate shall be a bright pink color that is
25 easily distinguishable from other plates issued in this state.
26 The word "Florida" must appear at the top of the plate and the
27 first three letters in the alphanumeric numbering system used
28 on the plate must be "DUI".
29 (3) In addition to the other license plate fees and
30 charges collected, an annual surcharge of $20 shall be
31 collected for each DUI plate. The proceeds from the surcharge

1 shall be deposited into the Trauma Services Trust Fund created
2 by s. 395.4034, Florida Statutes, and used for purposes
3 provided in that section.
4 (4) A law enforcement officer may stop any vehicle
5 that bears a DUI plate without probable cause to check the
6 operator for compliance with the restrictions provided in s.
7 316.193, Florida Statutes.
8 Section 2. This act shall take effect July 1, 2006.

11 SENATE SUMMARY
12 Creates a DUI license plate and requires persons whose
driving privileges are restricted because of certain
13 violations related to driving under the influence to
drive only vehicles that display such plates. Provides a
14 surcharge for such plates and provides for the use of
proceeds from the sale of such plates.
