  1                      A bill to be entitled

  2         An act relating to the use of Tasers;

  3         prohibiting the use of a Taser or similar

  4         device on an individual whom the user knows or

  5         should have known to be a person 16 years of

  6         age or younger; providing penalties; providing

  7         an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Use of certain stun guns on a person 16

12  years of age or younger.--

13         (1)  A person, including, but not limited to, a law

14  enforcement officer, may not use a Taser stun gun or a similar

15  conductive-energy device on an individual whom the person

16  knows or should have known to be a person 16 years of age or

17  younger.

18         (2)  A person who violates subsection (1) commits a

19  misdemeanor of the first degree, punishable as provided in s.

20  775.082 or s. 775.083, Florida Statutes.

21         Section 2.  This act shall take effect upon becoming a

22  law.
