11 The Committee on Community Affairs (Haridopolos) recommended
12 the following substitute for amendment (694498):
13
14 Senate Amendment (with title amendment)
15 On page 2, line 26, after the period,
16
17 insert: However, the governmental entity or other party
18 allegedly violating this subsection must be provided 90 days'
19 written notice by the sign owner of such alleged violation,
20 and a penalty may not be assessed if the alleged violation is
21 cured by the governmental entity or other party within the
22 90-day period. Any modifications or removal of material within
23 a beautification project or other planning by the governmental
24 entity or other party to cure an alleged violation does not
25 require the issuance of a permit from the Department of
26 Transportation if not less than 48 hours' notice of the
27 modification or removal of the material is provided to the
28 department. A natural person, private corporation, or private
29 partnership licensed under part II of chapter 481 which
30 provides design services for beautification or other projects
31 is not subject to a penalty under this subsection if the

1 initial project design meets the requirements of this
2 subsection.
