12  recommended the following amendment:

14         Senate Amendment (with title amendment) 
15         On page 2, line 26, after the period,
16  
17  insert:  However, the governmental entity or other party
18  violating this subsection must be provided written notice of
19  such violation and a penalty may not be assessed if the
20  violation is cured within 90 days after the notice is received
21  by the entity or other party. An individual, nongovernmental
22  corporation, or private partnership licensed under part II of
23  chapter 481 which provides design services for beautification
24  or other projects is not subject to a penalty under this
25  subsection if the initial project design meets the
26  requirements of this subsection.
