1 A bill to be entitled
2 An act relating to paintball guns and markers;
3 defining the terms "paintball gun" and
4 "paintball marker"; prohibiting a person from
5 carrying a paintball gun or a paintball marker
6 in a vehicle on the highway; providing
7 specified exceptions; providing that the act
8 does not apply to a commercial paintball field,
9 range, or course operator when the operator
10 transports passengers to and from designated
11 player areas; providing that a violation of the
12 act is a first-degree misdemeanor; providing an
13 effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Paintball guns and paintball markers.--
18 (1) As used in this section, the term:
19 (a) "Paintball gun" means a device designed and
20 manufactured to propel, by gas or air, an encapsulated gelatin
21 paintball.
22 (b) "Paintball marker" means a device designed and
23 manufactured to propel, by gas or air, an encapsulated gelatin
24 paintball.
25 (2) Except as set forth in subsection (3), a person
26 may not carry a paintball gun or a paintball marker in a
27 vehicle on the highway unless:
28 (a) The paintball gun or paintball marker is
29 disassembled so that the propellant canister is separate from
30 the rest of the device and the device is empty of encapsulated
31 gelatin paintballs; or

1 (b) The propellant canister of the paintball gun or
2 paintball marker has been emptied of its gas or air propellant
3 and the device is empty of encapsulated gelatin paintballs.
4 (3) Subsection (2) does not apply to a commercial
5 paintball field, range, or course when passengers are being
6 transported by the commercial field, range, or course operator
7 to and from designated player areas.
8 (4) A person who violates this section commits a
9 misdemeanor of the first degree, punishable as provided in s.
10 775.082 or s. 775.083, Florida Statutes.
11 Section 2. This act shall take effect July 1, 2006.

14 SENATE SUMMARY
15 Prohibits a person from carrying a paintball gun or a
paintball marker in a vehicle on the highway. Provides
16 specified exceptions. Provides that the act does not
apply to a commercial paintball field, range, or course
17 operator when the operator transports passengers to and
from designated player areas. Provides that a person who
18 violates the act commits a misdemeanor of the first
degree. Provides criminal penalties.
