15 On page 1, lines 10-13, delete those lines

17 and insert:
18 Section 1. Subsections (5), (6), (7), (8), and (9) of
19 section 561.695, Florida Statutes, are amended to read:
20 561.695 Stand-alone bar enforcement; qualification;
21 penalties.--
22 (5) After the initial designation, to continue to
23 qualify as a stand-alone bar the licensee must provide to the
24 division annually, on or before the licensee's annual renewal
25 date, an affidavit that certifies, with respect to the
26 preceding 12-month period, the following:
27 (a) No more than 10 percent of the gross revenue of
28 the business is from the sale of food consumed on the licensed
29 premises as defined in s. 386.203(11).
30 (b) Other than customary bar snacks as defined by rule
31 of the division, the licensed vendor does not provide or serve

1 food to a person on the licensed premises without requiring
2 the person to pay a separately stated charge for food that
3 reasonably approximates the retail value of the food.
4 (c) The licensed vendor conspicuously posts signs at
5 each entrance to the establishment stating that smoking is
6 permitted in the establishment.

8 The division shall establish by rule the format of the
9 affidavit required by this subsection. A licensed vendor may
10 not knowingly make a false statement on the affidavit required
11 by this subsection. In addition to the penalties provided in
12 subsection (7), a vendor who knowingly makes a false statement
13 on the affidavit required by this subsection is subject to
14 suspension or revocation of his or her alcoholic beverage
15 license under s. 561.29.

22 insert:
23 providing for a penalty to be imposed against a
24 licensed vendor who knowingly makes a false
25 statement on an annual compliance affidavit;
