A bill to be entitled
2An act relating to gasoline stations; creating the
3"Consumer Emergency Gasoline Act"; requiring that retail
4gasoline stations be equipped with an alternative means of
5power generation so that the station's fuel pumps may be
6operated in the event of a power outage; providing a
7period for existing retail gasoline stations to comply
8with the act; providing a penalty; providing an effective
9date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Consumer Emergency Gasoline Act.--
14     (1)  Any gasoline station that offers motor fuel for sale
15at retail to the public must be equipped with an alternative
16means of power generation on site so that the station's fuel
17pumps may be operated in the event of a power outage. The
18alternative means of power generation must be maintained and
19kept fully operational at all times and the gasoline station
20must be capable of pumping motor fuel immediately following a
21loss of power.
22     (2)  Subsection (1) applies to any newly constructed
23gasoline station for which a certificate of occupancy is issued
24on or after June 1, 2006. A gasoline station that obtained a
25certificate of occupancy before June 1, 2006, has until December
261, 2007, to comply with the requirements of subsection (1).
27     (3)  A violation of subsection (1) is a misdemeanor of the
28second degree, punishable as provided in s. 775.082 or s.
29775.083.
30     Section 2.  This act shall take effect June 1, 2006.
