7organizations; amending s. 641.316, F.S.; redefining the
8term "fiscal intermediary services organization"; revising
9registration requirements for fiscal intermediary services
10organizations; providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  Paragraph (b) of subsection (2) and subsection
15(6) of section 641.316, Florida Statutes, are amended to read:
16     641.316  Fiscal intermediary services.--
17     (2)
18     (b)  The term "fiscal intermediary services organization"
19means a person or entity that which performs fiduciary or fiscal
20intermediary services to health care professionals who contract
21with health maintenance organizations other than a fiscal
22intermediary services organization owned, operated, or
23controlled by a hospital licensed under chapter 395, an insurer
24licensed under chapter 624, a third-party administrator licensed
25under chapter 626, a prepaid limited health service organization
26licensed under chapter 636, a health maintenance organization
27licensed under this chapter, or physician group practices as
28defined in s. 456.053(3)(h) and providing services under the
29scope of licenses of the members of the group practice.
30     (6)  Any fiscal intermediary services organization, other
31than a fiscal intermediary services organization owned,
32operated, or controlled by a hospital licensed under chapter
33395, an insurer licensed under chapter 624, a third-party
34administrator licensed under chapter 626, a prepaid limited
35health service organization licensed under chapter 636, a health
36maintenance organization licensed under this chapter, or
37physician group practices as defined in s. 456.053(3)(h), and
38providing services under the scope of licenses of the members of
39the group practice, must register with the office and meet the
40requirements of this section. In order to register as a fiscal
41intermediary services organization, the organization must comply
42with ss. 641.21(1)(c), and (d), and (j), and 641.22(6), and
43641.27. The fiscal intermediary services organization must also
44comply with the provisions of ss. 641.3155, 641.3156, and
45641.51(4). Should the office determine that the fiscal
46intermediary services organization does not meet the
47requirements of this section, the registration shall be denied.
48In the event that the registrant fails to maintain compliance
49with the provisions of this section, the office may revoke or
50suspend the registration. In lieu of revocation or suspension of
51the registration, the office may levy an administrative penalty
52in accordance with s. 641.25.
53     Section 2.  This act shall take effect October 1, 2006.
