12 | Be It Enacted by the Legislature of the State of Florida: |
13 |

14 | Section 1. Paragraph (b) of subsection (2) and subsection |
15 | (6) of section 641.316, Florida Statutes, are amended to read: |
16 | 641.316 Fiscal intermediary services.-- |
17 | (2) |
18 | (b) The term "fiscal intermediary services organization" |
19 | means a person or entity that which performs fiduciary or fiscal |
20 | intermediary services to health care professionals who contract |
21 | with health maintenance organizations other than a fiscal |
22 | intermediary services organization owned, operated, or |
23 | controlled by a hospital licensed under chapter 395, an insurer |
24 | licensed under chapter 624, a third-party administrator licensed |
25 | under chapter 626, a prepaid limited health service organization |
26 | licensed under chapter 636, a health maintenance organization |
27 | licensed under this chapter, or physician group practices as |
28 | defined in s. 456.053(3)(h) and providing services under the |
29 | scope of licenses of the members of the group practice. |
30 | (6) Any fiscal intermediary services organization, other |
31 | than a fiscal intermediary services organization owned, |
32 | operated, or controlled by a hospital licensed under chapter |
33 | 395, an insurer licensed under chapter 624, a third-party |
34 | administrator licensed under chapter 626, a prepaid limited |
35 | health service organization licensed under chapter 636, a health |
36 | maintenance organization licensed under this chapter, or |
37 | physician group practices as defined in s. 456.053(3)(h), and |
38 | providing services under the scope of licenses of the members of |
39 | the group practice, must register with the office and meet the |
40 | requirements of this section. In order to register as a fiscal |
41 | intermediary services organization, the organization must comply |
42 | with ss. 641.21(1)(c), and (d), and (j), and 641.22(6), and |
43 | 641.27. The fiscal intermediary services organization must also |
44 | comply with the provisions of ss. 641.3155, 641.3156, and |
45 | 641.51(4). Should the office determine that the fiscal |
46 | intermediary services organization does not meet the |
47 | requirements of this section, the registration shall be denied. |
48 | In the event that the registrant fails to maintain compliance |
49 | with the provisions of this section, the office may revoke or |
50 | suspend the registration. In lieu of revocation or suspension of |
51 | the registration, the office may levy an administrative penalty |
52 | in accordance with s. 641.25. |
53 | Section 2. This act shall take effect October 1, 2006. |
