  1                      A bill to be entitled

  2         An act relating to public sheltering of sexual

  3         offenders and predators; amending s. 252.385,

  4         F.S.; requiring each county to plan for

  5         sufficient separate and exclusive shelter space

  6         for sexual offenders and designated sexual

  7         predators in public evacuation shelters;

  8         providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Subsection (5) is added to section 252.385,

13  Florida Statutes, to read:

14         252.385  Public shelter space.--

15         (5)  Each county shall develop a plan for sufficient

16  separate and exclusive evacuation shelter space for

17  individuals subject to registration as sexual offenders under

18  s. 943.0435 or designated as sexual predators under s. 775.21

19  in the event of a hurricane or other natural disaster that

20  requires public sheltering. However, this subsection does not

21  prohibit a county from using a designated area within the same

22  building or room that is used to shelter the general public.

23         Section 2.  This act shall take effect January 1, 2007.

 1          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
 2                         Senate Bill 638

 3                                 

 4  Deletes all language from previous bill and requires each
    county to develop a plan for the provision of separate and
 5  exclusive shelter space for sexual offenders required to
    register under s. 943.0435, F.S., and designated sexual
 6  predators under s. 775.21, F.S., when a hurricane or other
    natural disaster requires public sheltering. A county may not
 7  be prohibited from using a designated area for offenders and
    predators that is in the same building or room that is used to
 8  shelter the public.
