8474.203, F.S.; providing that ch. 474, F.S., relating to
9veterinary medical practice, does not apply to a part-time
10worker or an independent contractor who is hired by an
11owner to provide certain services; providing an effective
12date.

14Be It Enacted by the Legislature of the State of Florida:
15
16     Section 1.  Subsection (5) of section 474.203, Florida
17Statutes, is amended to read:
18     474.203  Exemptions.--This chapter shall not apply to:
19     (5)(a)  Any person, or the person's regular employee,
20administering to the ills or injuries of her or his own animals,
21including, but not limited to, castration, spaying, and
22dehorning of herd animals, unless title has been transferred or
23employment provided for the purpose of circumventing this law.
24This exemption shall not apply to out-of-state veterinarians
25practicing temporarily in the state. However, only a
26veterinarian may immunize or treat an animal for diseases which
27are communicable to humans and which are of public health
28significance.
29     (b)  A person hired on a part-time or temporary basis, or
30as an independent contractor, by an owner to assist with herd
31management, wellness, and animal husbandry tasks for herd and
32flock animals, including castration, dehorning, parasite
33control, and debeaking, or a person hired on a part-time or
34temporary basis, or as an independent contractor, by an owner to
35provide farriery and manual hand floating of teeth on equines.

37For the purposes of chapters 465 and 893, persons exempt
38pursuant to subsection (1), subsection (2), or subsection (4)
39are deemed to be duly licensed practitioners authorized by the
40laws of this state to prescribe drugs or medicinal supplies.
41     Section 2.  This act shall take effect July 1, 2006.
