2An act relating to nursing home facilities; creating s.
3400.0627, F.S.; providing legislative intent; requiring
4the Agency for Health Care Administration to reimburse
5nursing home facilities for the cost of building or
6modifying their emergency electrical power systems to
7fully operate during and after an emergency; providing
8eligibility criteria for reimbursement; providing an
9appropriation; providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Section 400.0627, Florida Statutes, is created
14to read:
15     400.0627  Emergency electrical power system capacity.--
16     (1)  It is the intent of the Legislature that each nursing
17home facility in this state be encouraged to have an emergency
18electrical power system capacity that is sufficient to remain
19fully operational during and after an emergency in order to
20maintain the safety and health of the residents of the nursing
21home facility and, if necessary, to provide care to residents
22evacuated from other nursing home facilities.
23     (2)  The agency shall reimburse an eligible nursing home
24facility for the costs of building or modifying its emergency
25electrical power system capacity to fully operate the facility
26during and after an emergency. To be eligible for reimbursement,
27a nursing home facility must:
28     (a)  Not have been cited for any class I deficiency within
29the 30 months preceding the application for reimbursement;
30     (b)  Not be located within the hurricane evacuation zone of
31the county in which it is located;
32     (c)  Have the capacity, as determined by the agency, to
33care for residents evacuated from other nursing home facilities
34during an emergency; and
35     (d)  Agree to receive residents who are transferred from
36other nursing home facilities.
37     (3)  This section does not require a nursing home facility
38to modify its existing emergency electrical power system
39capacity.
40     Section 2.  The sum of $          is appropriated from the
41General Revenue Fund to the Agency for Health Care
42Administration for the purpose of reimbursing eligible nursing
43home facilities for the costs of building or modifying their
44emergency electrical power system capacity to fully operate the
45facility during and after an emergency during the 2006-2007
46fiscal year.
47     Section 3.  This act shall take effect upon becoming a law.
