11 The Committee on Transportation (Bennett) recommended the
12 following amendment:

15 On page 2, lines 1-12, delete those lines
16
17 and insert:
18 (b) A possessory lien upon any vessel in a wrecked,
19 junked, or substantially dismantled condition, which has been
20 left abandoned at the marina, for expenses reasonably incurred
21 in the removal and disposal of the vessel. The possessory lien
22 shall attach as of the date the vessel arrives at the marina
23 or as of the date the vessel first occupies rental space at
24 the marina facility. If the funds recovered from the sale of
25 the vessel, or from the scrap or salvage value of the vessel,
26 are insufficient to cover the expenses reasonably incurred by
27 the marina in removing and disposing of the vessel, all costs
28 in excess of recovery shall be recoverable against the owner
29 of the vessel. For a vessel damaged as a result of a named
30 storm, the provisions of this paragraph shall be suspended for
31 60 days following the date the vessel is damaged in the named

1 storm. The operation of the provisions specified in this
2 paragraph run concurrently with, and do not extend, the 60-day
3 notice periods provided in subsections (5) and (7).
