10401.111, F.S.; providing for grants to youth athletic
11organizations for automated external defibrillator
12devices; amending s. 401.113, F.S.; providing for
13disbursement of funds from the Emergency Medical Services
14Trust Fund; requiring the Department of Health to
15implement an educational campaign to inform persons who
16acquire automated external defibrillator devices of the
17scope and limitations of the immunity from liability
18provided under the Cardiac Arrest Survival Act; providing
19an effective date.

21Be It Enacted by the Legislature of the State of Florida:
22
23     Section 1.  Short title.--This act may be cited as the
24"Gordon and Miulli Act."
25     Section 2.  Subsections (6) and (7) are added to section
26401.107, Florida Statutes, to read:
27     401.107  Definitions.--As used in this part, the term:
28     (6)  "Youth athletic organization" means a private
29not-for-profit organization that promotes and provides organized
30athletic activities to youth.
31     (7)  "Automated external defibrillator device" means a
32device as defined in s. 768.1325(2)(b).
33     Section 3.  Section 401.111, Florida Statutes, is amended
34to read:
35     401.111  Emergency medical services grant program;
36authority.--The department is hereby authorized to make grants
37to local agencies, and emergency medical services organizations,
38and youth athletic organizations in accordance with any
39agreement entered into pursuant to this part. These grants shall
40be designed to assist local said agencies and emergency medical
41services organizations in providing emergency medical services,
42including emergency medical dispatch, and to assist youth
43athletic organizations that work in conjunction with local
44emergency medical services organizations to expand the use of
45automated external defibrillator devices in the community. The
46cost of administering this program shall be paid by the
47department from funds appropriated to it.
48     Section 4.  Paragraphs (a) and (b) of subsection (2) of
49section 401.113, Florida Statutes, are amended to read:
50     401.113  Department; powers and duties.--
51     (2)  The department shall annually dispense funds contained
52in the Emergency Medical Services Trust Fund as follows:
53     (a)  Forty-five percent of such moneys must be divided
54among the counties according to the proportion of the combined
55amount deposited in the trust fund from the county. These funds
56may not be used to match grant funds as identified in paragraph
57(b). An individual board of county commissioners may distribute
58these funds to emergency medical services service organizations
59and youth athletic organizations within the county, as it deems
60appropriate.
61     (b)  Forty percent of such moneys must be used by the
62department for making matching grants to local agencies,
63municipalities, and emergency medical services organizations,
64and youth athletic organizations for the purpose of conducting
65research, increasing existing levels of emergency medical
66services, evaluation, community education, injury-prevention
67programs, and training in cardiopulmonary resuscitation and
68other lifesaving and first aid techniques.
69     1.  At least 90 percent of these moneys must be made
70available on a cash matching basis. A grant made under this
71subparagraph must be contingent upon the recipient providing a
72cash sum equal to 25 percent of the total department-approved
73grant amount.
74     2.  No more than 10 percent of these moneys must be made
75available to rural emergency medical services, and
76notwithstanding the restrictions specified in subsection (1),
77these moneys may be used for improvement, expansion, or
78continuation of services provided. A grant made under this
79subparagraph must be contingent upon the recipient providing a
80cash sum equal to no more than 10 percent of the total
81department-approved grant amount.

83The department shall develop procedures and standards for grant
84disbursement under this paragraph based on the need for
85emergency medical services, the requirements of the population
86to be served, and the objectives of the state emergency medical
87services plan.
88     Section 5.  The Department of Health shall implement an
89educational campaign to inform any person who acquires an
90automated external defibrillator device of the scope and
91limitations of the immunity from liability provided under s.
92768.1325, Florida Statutes.
93     Section 6.  This act shall take effect July 1, 2006.
