  1                      A bill to be entitled

  2         An act relating to hospital regulations;

  3         creating s. 395.1019, F.S.; requiring certain

  4         medical facilities to provide information about

  5         emergency contraception to victims of sexual

  6         assault; requiring the Agency for Health Care

  7         Administration and the Division of Victim

  8         Services of the Office of the Attorney General

  9         to prepare and produce the information

10         regarding emergency contraception; requiring

11         certain medical facilities to have training

12         policies and procedures about the use and

13         dissemination of emergency contraception to

14         victims of sexual assault; providing an

15         effective date.

17  Be It Enacted by the Legislature of the State of Florida:

18  

19         Section 1.  395.1019  Emergency services for victims of

20  sexual assault.--

21         (1)  A licensed facility that provides emergency room

22  services shall:

23         (a)  Provide to a victim of sexual assault medically

24  and factually accurate and objective oral and written

25  information concerning emergency contraception;

26         (b)  Orally inform a victim of sexual assault of her

27  option to be provided an emergency contraceptive at the

28  licensed facility; and

29         (c)  Immediately provide an emergency contraceptive to

30  a victim of sexual assault who requests it.

 1         (2)  As used in this section, the term "sexual assault"

 2  means:

 3         (a)  Sexual battery, as defined in chapter 794;

 4         (b)  A lewd and lascivious act, as defined in chapter

 5  800;

 6         (c)  Sexual conduct as defined in chapter 827;

 7         (d)  Deviate sexual intercourse as defined in chapter

 8  827; or

 9         (e)  Any other forcible felony wherein a sexual act is

10  committed or attempted,

11  

12  regardless of whether criminal charges were filed, reduced, or

13  dismissed by the state attorney.

14         (3)  The Agency for Health Care Administration, in

15  cooperation with the Division of Victim Services within the

16  Office of the Attorney General, shall develop, prepare, and

17  produce written information relating to emergency

18  contraception for distribution and use in each licensed

19  facility that provides emergency room services in this state.

20         (4)  The written information regarding emergency

21  contraception must be clearly written, readily comprehensible,

22  unbiased, and medically and factually accurate.

23         (5)  A licensed facility that provides emergency room

24  services shall have written policies and procedures to ensure

25  that a health care professional who provides care or

26  information to a victim of sexual assault is trained to

27  provide medically and factually accurate and objective

28  information concerning emergency contraception to the victim

29  of sexual assault.

30         Section 2.  This act shall take effect October 1, 2006.
