5 | Section 4. Section 336.68, Florida Statutes, is created to |
6 | read: |
7 | 336.68 Special road and bridge district boundaries; |
8 | property owner rights and options.-- |
9 | (1) The owner of real property located within both the |
10 | boundaries of a community development district created under |
11 | chapter 190 and within the boundaries of a special road and |
12 | bridge district created by the alternative method of |
13 | establishing special road and bridge districts previously |
14 | authorized under ss. 336.61-336.67 shall have the option to |
15 | select the community development district to be the provider of |
16 | the road and drainage improvements to the property of the owner. |
17 | Having made the selection, the property owner shall further have |
18 | the right to withdraw the property from the boundaries of the |
19 | special road and bridge district under the procedures set forth |
20 | in this section. |
21 | (2) To be eligible for withdrawal, the subject property |
22 | shall not have received improvements or benefits from the |
23 | special road and bridge district; there shall be no outstanding |
24 | bonded indebtedness of the special road and bridge district for |
25 | which the property is subject to ad valorem tax levies; and the |
26 | withdrawal of the property shall not create an enclave bounded |
27 | on all sides by the other property within the boundaries of the |
28 | district when the property owner withdraws the property from the |
29 | boundaries of the district. |
30 | (3) The election by a property owner to withdraw property |
31 | from the boundaries of a district as described in this section |
32 | shall be accomplished by filing a certificate in the official |
33 | records of the county in which the property is located. The |
34 | certificate shall identify the name and mailing address of the |
35 | owner, the legal description of the property, the name of the |
36 | district from which the property is being withdrawn, and the |
37 | general location of the property within district. The |
38 | certificate shall further state that the property has not |
39 | received benefits from the district from which the property is |
40 | to be withdrawn; that there is no bonded indebtedness owed by |
41 | the district; and that the property being withdrawn will not |
42 | become an enclave within the district boundaries. |
43 | (4) The property owner shall provide copies of the |
44 | recorded certificate to the governing body of the district from |
45 | which the property is being withdrawn within days 10 days after |
46 | the date that the certificate is recorded. If the district does |
47 | not record an objection to the withdrawal of the property in the |
48 | public records within 30 days after the recording of the |
49 | certificate identifying the criteria in this section that has |
50 | not been met, the withdrawal shall be final and the property |
51 | shall be permanently withdrawn from the boundaries of the |
52 | district. |
