3     Amendment (with title amendment)
4     Between lines 392 and 393 insert:
5     Section 4.  Section 336.68, Florida Statutes, is created to
6read:
7     336.68  Special road and bridge district boundaries;
8property owner rights and options.--
9     (1)  The owner of real property located within both the
10boundaries of a community development district created under
11chapter 190 and within the boundaries of a special road and
12bridge district created by the alternative method of
13establishing special road and bridge districts previously
14authorized under ss. 336.61-336.67 shall have the option to
15select the community development district to be the provider of
16the road and drainage improvements to the property of the owner.
17Having made the selection, the property owner shall further have
18the right to withdraw the property from the boundaries of the
19special road and bridge district under the procedures set forth
20in this section.
21     (2)  To be eligible for withdrawal, the subject property
22shall not have received improvements or benefits from the
23special road and bridge district; there shall be no outstanding
24bonded indebtedness of the special road and bridge district for
25which the property is subject to ad valorem tax levies; and the
26withdrawal of the property shall not create an enclave bounded
27on all sides by the other property within the boundaries of the
28district when the property owner withdraws the property from the
29boundaries of the district.
30     (3)  The election by a property owner to withdraw property
31from the boundaries of a district as described in this section
32shall be accomplished by filing a certificate in the official
33records of the county in which the property is located. The
34certificate shall identify the name and mailing address of the
35owner, the legal description of the property, the name of the
36district from which the property is being withdrawn, and the
37general location of the property within district. The
38certificate shall further state that the property has not
39received benefits from the district from which the property is
40to be withdrawn; that there is no bonded indebtedness owed by
41the district; and that the property being withdrawn will not
42become an enclave within the district boundaries.
43     (4)  The property owner shall provide copies of the
44recorded certificate to the governing body of the district from
45which the property is being withdrawn within days 10 days after
46the date that the certificate is recorded. If the district does
47not record an objection to the withdrawal of the property in the
48public records within 30 days after the recording of the
49certificate identifying the criteria in this section that has
50not been met, the withdrawal shall be final and the property
51shall be permanently withdrawn from the boundaries of the
52district.
