  1                      A bill to be entitled

  2         An act relating to automated teller machine

  3         transaction charges; creating s. 655.966, F.S.;

  4         authorizing the owner of an automated teller

  5         machine to charge an access fee or surcharge

  6         for transactions using accounts from certain

  7         financial institutions; providing an effective

  8         date.

10  Be It Enacted by the Legislature of the State of Florida:

12         Section 1.  Section 655.966, Florida Statutes, is

13  created to read:

14         655.966  Automated teller machine; surcharge.--The

15  owner of an automated teller machine, as defined in s.

16  655.960, may charge an access fee or surcharge to a customer

17  conducting a transaction using an account from a financial

18  institution, as defined in s. 655.005, which is located

19  outside of the United States.

20         Section 2.  This act shall take effect July 1, 2006.
