12 | Be It Enacted by the Legislature of the State of Florida: |
13 |

14 | Section 1. Section 252.63, Florida Statutes, is created to |
15 | read: |
16 | 252.63 Florida Disaster Supplier Program.-- |
17 | (1) SHORT TITLE.--This section may be cited as the |
18 | "Florida Disaster Supplier Program Act." |
19 | (2) FLORIDA DISASTER SUPPLIER PROGRAM.--The Florida |
20 | Disaster Supplier Program is created within the division for the |
21 | purpose of providing statewide oversight of the availability and |
22 | provision of necessary supplies prior to, during, and following |
23 | a state of emergency or natural or manmade disaster or |
24 | catastrophe. Participation in the program shall be at the option |
25 | of each county governing body within the state. Each county |
26 | choosing to participate in the program shall be primarily |
27 | responsible for administering the program within that county. |
28 | (3) FLORIDA DISASTER SUPPLIER PROGRAM COMMITTEE.-- |
29 | (a) There is created the Florida Disaster Supplier Program |
30 | Committee. The committee shall be composed of the county |
31 | emergency operations directors from the nine most populous |
32 | counties in the state or their designees. The committee shall be |
33 | charged with the responsibility of establishing the Florida |
34 | Disaster Supplier Program. |
35 | (b) The members of the committee shall elect a chair and a |
36 | vice chair from among their membership. The chair shall preside |
37 | at all meetings of the committee. |
38 | (c) The committee shall meet at the call of the chair or |
39 | at the request of a majority of its membership. |
40 | (d) Members shall serve for the duration of the existence |
41 | of the committee. A vacancy on the committee shall be filled by |
42 | the chair for the remainder of the unexpired term. |
43 | (e) Members of the committee shall serve without |
44 | compensation but shall be entitled to per diem and travel |
45 | expenses as provided in s. 112.061 while engaged in the |
46 | performance of their duties. |
47 | (4) DUTIES AND RESPONSIBILITIES.--Duties and |
48 | responsibilities of the committee shall include, but not be |
49 | limited to, recommending to the division: |
50 | (a) State disaster preparedness criteria necessary to the |
51 | implementation of the program. |
52 | (b) A system of certification for disaster suppliers in |
53 | the following categories: |
54 | 1. Medicine. |
55 | 2. Gasoline. |
56 | 3. Ice. |
57 | (c) The assessment of an annual license fee for businesses |
58 | seeking to obtain certification as a state disaster supplier |
59 | under the program and caps and guidelines for such license fee. |
60 | (d) A uniform state logo that bears the names of the |
61 | respective counties participating in the program. |
62 | (5) USE OF LICENSE FEES.--License fees recommended by the |
63 | committee must be apportioned with 90 percent of the license |
64 | fees to be used by the participating counties for emergency |
65 | disaster preparedness and 10 percent of the license fees to be |
66 | deposited in the State Treasury into the General Revenue Fund. |
67 | (6) REPORT.--The committee shall submit a report on the |
68 | development and implementation of the program to the Governor, |
69 | the Speaker of the House of Representatives, and the President |
70 | of the Senate no later than July 1, 2009. The report shall |
71 | include recommendations for any needed legislation with respect |
72 | to the provision of supplies within the state during a state of |
73 | emergency or natural or manmade disaster or catastrophe. |
74 | (7) TERMINATION.--The committee shall terminate on July 1, |
75 | 2009. |
76 | Section 2. This act shall take effect July 1, 2006. |
