6Program Committee; providing purpose, membership, terms,
7and organization of the committee; providing duties and
8responsibilities of the committee; requiring a report;
9providing for termination of the committee; providing an
10effective date.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  Section 252.63, Florida Statutes, is created to
15read:
16     252.63  Florida Disaster Supplier Program.--
17     (1)  SHORT TITLE.--This section may be cited as the
18"Florida Disaster Supplier Program Act."
19     (2)  FLORIDA DISASTER SUPPLIER PROGRAM.--The Florida
20Disaster Supplier Program is created within the division for the
21purpose of providing statewide oversight of the availability and
22provision of necessary supplies prior to, during, and following
23a state of emergency or natural or manmade disaster or
24catastrophe. Participation in the program shall be at the option
25of each county governing body within the state. Each county
26choosing to participate in the program shall be primarily
27responsible for administering the program within that county.
28     (3)  FLORIDA DISASTER SUPPLIER PROGRAM COMMITTEE.--
29     (a)  There is created the Florida Disaster Supplier Program
30Committee. The committee shall be composed of the county
31emergency operations directors from the nine most populous
32counties in the state or their designees. The committee shall be
33charged with the responsibility of establishing the Florida
34Disaster Supplier Program.
35     (b)  The members of the committee shall elect a chair and a
36vice chair from among their membership. The chair shall preside
37at all meetings of the committee.
38     (c)  The committee shall meet at the call of the chair or
39at the request of a majority of its membership.
40     (d)  Members shall serve for the duration of the existence
41of the committee. A vacancy on the committee shall be filled by
42the chair for the remainder of the unexpired term.
43     (e)  Members of the committee shall serve without
44compensation but shall be entitled to per diem and travel
45expenses as provided in s. 112.061 while engaged in the
46performance of their duties.
47     (4)  DUTIES AND RESPONSIBILITIES.--Duties and
48responsibilities of the committee shall include, but not be
49limited to, recommending to the division:
50     (a)  State disaster preparedness criteria necessary to the
51implementation of the program.
52     (b)  A system of certification for disaster suppliers in
53the following categories:
54     1.  Medicine.
55     2.  Gasoline.
56     3.  Ice.
57     (c)  The assessment of an annual license fee for businesses
58seeking to obtain certification as a state disaster supplier
59under the program and caps and guidelines for such license fee.
60     (d)  A uniform state logo that bears the names of the
61respective counties participating in the program.
62     (5)  USE OF LICENSE FEES.--License fees recommended by the
63committee must be apportioned with 90 percent of the license
64fees to be used by the participating counties for emergency
65disaster preparedness and 10 percent of the license fees to be
66deposited in the State Treasury into the General Revenue Fund.
67     (6)  REPORT.--The committee shall submit a report on the
68development and implementation of the program to the Governor,
69the Speaker of the House of Representatives, and the President
70of the Senate no later than July 1, 2009. The report shall
71include recommendations for any needed legislation with respect
72to the provision of supplies within the state during a state of
73emergency or natural or manmade disaster or catastrophe.
74     (7)  TERMINATION.--The committee shall terminate on July 1,
752009.
76     Section 2.  This act shall take effect July 1, 2006.
