7 | Statutes, is amended to read: |
8 | 627.733 Required security.-- |
9 | (1)(a) Every owner or registrant of a motor vehicle, other |
10 | than a motor vehicle used as a taxicab, school bus as defined in |
11 | s. 1006.25, or limousine, required to be registered and licensed |
12 | in this state shall maintain security as required by subsection |
13 | (3) in effect continuously throughout the registration or |
14 | licensing period. |
15 | (b) Every owner or registrant of a motor vehicle used as a |
16 | taxicab shall maintain security as required under s. 324.032(1). |
17 | Section 54. Subsection (1) of section 324.032, Florida |
18 | Statutes, is amended to read: |
19 | 324.032 Manner of proving financial responsibility; for- |
20 | hire passenger transportation vehicles.--Notwithstanding the |
21 | provisions of s. 324.031: |
22 | (1)(a) A person who is either the owner or a lessee |
23 | required to maintain insurance under s. 627.7331(1)(b) s. |
24 | 324.021(9)(b) and who operates one or more taxicabs, limousines, |
25 | jitneys, or any other for-hire passenger transportation vehicles |
26 | may prove financial responsibility by furnishing satisfactory |
27 | evidence of holding a motor vehicle liability policy as defined |
28 | in s. 324.031, but with minimum limits of |
29 | $125,000/250,000/50,000. |
30 | (b) A person who is either the owner or a lessee required |
31 | to maintain insurance under s. 324.021(9)(b) and who operates |
32 | limousines, jitneys, or any other for-hire passenger vehicles, |
33 | other than taxicabs, may prove financial responsibility by |
34 | furnishing satisfactory evidence of holding a motor vehicle |
35 | liability policy as defined in s. 324.031. |

37 | Upon request by the department, the applicant must provide the |
38 | department at the applicant's principal place of business in |
39 | this state access to the applicant's underlying financial |
40 | information and financial statements that provide the basis of |
41 | the certified public accountant's certification. The applicant |
42 | shall reimburse the requesting department for all reasonable |
43 | costs incurred by it in reviewing the supporting information. |
44 | The maximum amount of self-insurance permissible under this |
45 | subsection is $300,000 and must be stated on a per-occurrence |
46 | basis, and the applicant shall maintain adequate excess |
47 | insurance issued by an authorized or eligible insurer licensed |
48 | or approved by the Office of Insurance Regulation. All risks |
49 | self-insured shall remain with the owner or lessee providing it, |
50 | and the risks are not transferable to any other person, unless a |
51 | policy complying with subsection (1) is obtained. |
