18 Section 46. Subsection (1) of section 627.733, Florida
19 Statutes, is amended to read:
20 627.733 Required security.--
21 (1)(a) Every owner or registrant of a motor vehicle,
22 other than a motor vehicle used as a taxicab, school bus as
23 defined in s. 1006.25, or limousine, required to be registered
24 and licensed in this state shall maintain security as required
25 by subsection (3) in effect continuously throughout the
26 registration or licensing period.
27 (b) Every owner or registrant of a motor vehicle used
28 as a taxicab shall not be governed by paragraph (1)(a) but
29 shall maintain security as required under s. 324.032(1), and
30 s. 627.737 shall not apply to any motor vehicle used as a
31 taxicab.

1 Section 47. Subsection (1) of section 324.032, Florida
2 Statutes, is amended to read:
3 324.032 Manner of proving financial responsibility;
4 for-hire passenger transportation vehicles.--Notwithstanding
5 the provisions of s. 324.031:
6 (1)(a) A person who is either the owner or a lessee
7 required to maintain insurance under s. 627.733(1)(b) s.
8 324.021(9)(b) and who operates one or more taxicabs,
9 limousines, jitneys, or any other for-hire passenger
10 transportation vehicles may prove financial responsibility by
11 furnishing satisfactory evidence of holding a motor vehicle
12 liability policy as defined in s. 324.031, but with minimum
13 limits of $125,000/250,000/50,000.
14 (b) A person who is either the owner or a lessee
15 required to maintain insurance under s. 324.021(9)(b) and who
16 operates limousines, jitneys, or any other for-hire passenger
17 vehicles, other than taxicabs, may prove financial
18 responsibility by furnishing satisfactory evidence of holding
19 a motor vehicle liability policy as defined in s. 324.031.

21 Upon request by the department, the applicant must provide the
22 department at the applicant's principal place of business in
23 this state access to the applicant's underlying financial
24 information and financial statements that provide the basis of
25 the certified public accountant's certification. The applicant
26 shall reimburse the requesting department for all reasonable
27 costs incurred by it in reviewing the supporting information.
28 The maximum amount of self-insurance permissible under this
29 subsection is $300,000 and must be stated on a per-occurrence
30 basis, and the applicant shall maintain adequate excess
31 insurance issued by an authorized or eligible insurer licensed

1 or approved by the Office of Insurance Regulation. All risks
2 self-insured shall remain with the owner or lessee providing
3 it, and the risks are not transferable to any other person,
4 unless a policy complying with subsection (1) is obtained.
