4     Remove line(s) 2671-2741 and insert:
5     2.  Each school district or governing board that has a
6school designated with a grade of "F" for a second consecutive
7year after the community assessment team's recommendations to
8the school board or the governing board for implementing an
9assistance and intervention plan shall be subject to review and
10oversight by the State Board of Education as a school district
11or governing board with a school in a state of educational
12emergency.
13     3.  For each school district or governing board with a
14school in a state of educational emergency, the State Board of
15Education shall contact the district school board or the
16governing board to determine what actions have been taken by the
17district school board or the governing board to address the
18recommendations of the community assessment team and to resolve
19the educational emergency. The State Board of Education shall
20determine whether the district school board or the governing
21board needs state assistance to resolve the educational
22emergency. If state assistance is needed, the State Board of
23Education has the authority to implement measures as set forth
24in this subparagraph to assist the district school board or the
25governing board in resolving the educational emergency at the
26school. Such measures may include, but are not limited to:
27     a.  Requiring the State Board of Education's approval of
28the school district's budget or the governing board's budget for
29the school.
30     b.  Authorizing a state loan and providing for its
31repayment by the district school board or the governing board.
32     c.  Requiring the district school board or the governing
33board to reallocate funds as necessary until such time as the
34school district or the governing board no longer has a school in
35a state of educational emergency.
36     d.  Making inspections and reviews of any records,
37information, reports, and assets of the school district or the
38governing board for the purpose of improving the school's
39performance. The appropriate school district or governing board
40officials shall cooperate in such inspections and reviews.
41     e.  Consulting with officials and auditors of the school
42district or the governing board and the appropriate state
43officials regarding any steps necessary to bring the books of
44account, accounting systems, financial procedures, personnel,
45and personnel systems into compliance with state requirements
46for the purpose of improving the school's performance.
47     f.  Providing technical assistance to the district school
48board or the governing board.
49     g.  Establishing an educational emergency board to oversee
50the activities of the district school board or the governing
51board related to the school. If an educational emergency board
52is established, the State Board of Education shall appoint board
53members and select a chair. The community assessment team shall
54serve in an advisory capacity to the educational emergency
55board. The educational emergency board shall adopt such rules as
56are necessary for conducting board business. The board may
57review all of the educational operations, including, but not
58limited to, graduation and dropout rates, personnel, management,
59efficiency, curriculum, instructional materials, productivity,
60and financing of functions and operations, of the school
61district or the governing board related to the school. The
62recommendations and reports made by the educational emergency
63board must be submitted to the State Board of Education for
64appropriate action. Upon receipt of the educational emergency
65board's recommendations and report, the State Board of Education
66shall require an action plan to implement the educational
67emergency board's recommendations, to be prepared by officials
68of the school district or the governing board in consultation
69with the appropriate state officials, so as to cause the school
70to no longer be in a state of educational emergency.
71     4.  The State Board of Education may terminate all state
72actions pursuant to this paragraph upon determination that the
73school is no longer in a state of educational emergency and the
74school district or the governing board is operating an effective
75educational system for its students.
