5 | 2. Each school district or governing board that has a |
6 | school designated with a grade of "F" for a second consecutive |
7 | year after the community assessment team's recommendations to |
8 | the school board or the governing board for implementing an |
9 | assistance and intervention plan shall be subject to review and |
10 | oversight by the State Board of Education as a school district |
11 | or governing board with a school in a state of educational |
12 | emergency. |
13 | 3. For each school district or governing board with a |
14 | school in a state of educational emergency, the State Board of |
15 | Education shall contact the district school board or the |
16 | governing board to determine what actions have been taken by the |
17 | district school board or the governing board to address the |
18 | recommendations of the community assessment team and to resolve |
19 | the educational emergency. The State Board of Education shall |
20 | determine whether the district school board or the governing |
21 | board needs state assistance to resolve the educational |
22 | emergency. If state assistance is needed, the State Board of |
23 | Education has the authority to implement measures as set forth |
24 | in this subparagraph to assist the district school board or the |
25 | governing board in resolving the educational emergency at the |
26 | school. Such measures may include, but are not limited to: |
27 | a. Requiring the State Board of Education's approval of |
28 | the school district's budget or the governing board's budget for |
29 | the school. |
30 | b. Authorizing a state loan and providing for its |
31 | repayment by the district school board or the governing board. |
32 | c. Requiring the district school board or the governing |
33 | board to reallocate funds as necessary until such time as the |
34 | school district or the governing board no longer has a school in |
35 | a state of educational emergency. |
36 | d. Making inspections and reviews of any records, |
37 | information, reports, and assets of the school district or the |
38 | governing board for the purpose of improving the school's |
39 | performance. The appropriate school district or governing board |
40 | officials shall cooperate in such inspections and reviews. |
41 | e. Consulting with officials and auditors of the school |
42 | district or the governing board and the appropriate state |
43 | officials regarding any steps necessary to bring the books of |
44 | account, accounting systems, financial procedures, personnel, |
45 | and personnel systems into compliance with state requirements |
46 | for the purpose of improving the school's performance. |
47 | f. Providing technical assistance to the district school |
48 | board or the governing board. |
49 | g. Establishing an educational emergency board to oversee |
50 | the activities of the district school board or the governing |
51 | board related to the school. If an educational emergency board |
52 | is established, the State Board of Education shall appoint board |
53 | members and select a chair. The community assessment team shall |
54 | serve in an advisory capacity to the educational emergency |
55 | board. The educational emergency board shall adopt such rules as |
56 | are necessary for conducting board business. The board may |
57 | review all of the educational operations, including, but not |
58 | limited to, graduation and dropout rates, personnel, management, |
59 | efficiency, curriculum, instructional materials, productivity, |
60 | and financing of functions and operations, of the school |
61 | district or the governing board related to the school. The |
62 | recommendations and reports made by the educational emergency |
63 | board must be submitted to the State Board of Education for |
64 | appropriate action. Upon receipt of the educational emergency |
65 | board's recommendations and report, the State Board of Education |
66 | shall require an action plan to implement the educational |
67 | emergency board's recommendations, to be prepared by officials |
68 | of the school district or the governing board in consultation |
69 | with the appropriate state officials, so as to cause the school |
70 | to no longer be in a state of educational emergency. |
71 | 4. The State Board of Education may terminate all state |
72 | actions pursuant to this paragraph upon determination that the |
73 | school is no longer in a state of educational emergency and the |
74 | school district or the governing board is operating an effective |
75 | educational system for its students. |
