16 and insert:
17 (e) Notwithstanding restrictions in this section that
18 limit tax credit eligibility to costs that are integral to
19 site rehabilitation, in order to encourage the redevelopment
20 of properties in designated brownfield areas that are hindered
21 by the presence of solid waste, as defined in s. 403.703, a
22 tax credit applicant may also claim costs to address the solid
23 waste, but only those costs to remove, transport and dispose
24 of solid waste in accordance with department rules. These
25 costs are eligible for a tax credit provided the applicant
26 submits an affidavit stating that, after consultation with
27 appropriate local government officials and the department, to
28 the best of the applicant's knowledge, the site was never
29 operated as a landfill or dump site for monetary compensation,
30 a nd submits all other documentation and certifications
31 required by this section. In this section, where reference is
