| 5 | Section 15. Subsection (15) of section 373.414, Florida |
| 6 | Statutes, is amended to read: |
| 7 | 373.414 Additional criteria for activities in surface |
| 8 | waters and wetlands.-- |
| 9 | (15) Activities associated with mining operations as |
| 10 | defined by and subject to ss. 378.201-378.212 and 378.701- |
| 11 | 378.703 and included in a conceptual reclamation plan or |
| 12 | modification application submitted prior to July 1, 1996, shall |
| 13 | continue to be reviewed under the rules of the department |
| 14 | adopted pursuant to ss. 403.91-403.929, 1984 Supplement to the |
| 15 | Florida Statutes 1983, as amended, the rules of the water |
| 16 | management districts under this part, and interagency |
| 17 | agreements, in effect on January 1, 1993. Such activities shall |
| 18 | be exempt from rules adopted pursuant to subsection (9) and the |
| 19 | statewide methodology ratified pursuant to s. 373.4211. As of |
| 20 | January 1, 1994, such activities may be issued permits |
| 21 | authorizing construction for the life of the mine. Lands added |
| 22 | to a conceptual reclamation plan subject to this paragraph |
| 23 | through a modification submitted after July 1, 1996, that are |
| 24 | contiguous to the conceptual reclamation plan area and not |
| 25 | within the jurisdiction of a regional water supply authority |
| 26 | shall be exempt from rules adopted under subsection (9), |
| 27 | provided that the total acreage of the conceptual reclamation |
| 28 | plan may not be increased through such modification and the |
| 29 | cumulative acreage added may not exceed 3 percent of the |
| 30 | conceptual reclamation plan area. Lands that have been mined or |
| 31 | disturbed by mining activities, lands subject to a conservation |
| 32 | easement under which the grantee is a state or federal |
| 33 | regulatory agency, and lands otherwise preserved as a part of a |
| 34 | permitting review may not be removed from the conceptual |
| 35 | reclamation plan area under this subsection. |
