3     Amendment (with title amendment)
4     Remove lines 13-14 and insert:
5     Section 1.  Subsection (4) of section 796.07, Florida
6Statutes, is amended, subsections (5)and (6) of that section are
7redesignated as subsections (6) and (7), and a new subsection
8(5) is added to the section to read:
9     796.07  Prohibiting prostitution, etc.; evidence;
10penalties; definitions.--
11     (4)  Except as provided in subsection (5), a person who
12violates any provision of this section commits:
13     (a)  A misdemeanor of the second degree for a first
14violation, punishable as provided in s. 775.082 or s. 775.083.
15     (b)  A misdemeanor of the first degree for a second
16violation, punishable as provided in s. 775.082 or s. 775.083.
17     (c)  A felony of the third degree for a third or subsequent
18violation, punishable as provided in s. 775.082, s. 775.083, or
19s. 775.084.
20     (5)  A person who violates any provision of this section
21within 1,000 feet of the real property comprising a child care
22facility as defined in s. 402.302 that is in compliance with the
23signage requirements for child care facilities in s.
24893.13(1)(c); a public or private elementary, middle, or
25secondary school; or a physical place for worship where a church
26or religious organization regularly conducts religious services;
27or in, on, or within 1,000 feet of real property comprising a
28state, county, or municipal park, a community center, or a
29publicly owned recreational facility, the penalty shall be
30reclassified as follows:
31     1.  A misdemeanor of the second degree is reclassified to a
32misdemeanor of the first degree.
33     2.  A misdemeanor of the first degree is reclassified to a
34felony of the third degree.
35     3.  A felony of the third degree is reclassified to a
36felony of the second degree.
