5 | Section 1. Subsection (4) of section 796.07, Florida |
6 | Statutes, is amended, subsections (5)and (6) of that section are |
7 | redesignated as subsections (6) and (7), and a new subsection |
8 | (5) is added to the section to read: |
9 | 796.07 Prohibiting prostitution, etc.; evidence; |
10 | penalties; definitions.-- |
11 | (4) Except as provided in subsection (5), a person who |
12 | violates any provision of this section commits: |
13 | (a) A misdemeanor of the second degree for a first |
14 | violation, punishable as provided in s. 775.082 or s. 775.083. |
15 | (b) A misdemeanor of the first degree for a second |
16 | violation, punishable as provided in s. 775.082 or s. 775.083. |
17 | (c) A felony of the third degree for a third or subsequent |
18 | violation, punishable as provided in s. 775.082, s. 775.083, or |
19 | s. 775.084. |
20 | (5) A person who violates any provision of this section |
21 | within 1,000 feet of the real property comprising a child care |
22 | facility as defined in s. 402.302 that is in compliance with the |
23 | signage requirements for child care facilities in s. |
24 | 893.13(1)(c); a public or private elementary, middle, or |
25 | secondary school; or a physical place for worship where a church |
26 | or religious organization regularly conducts religious services; |
27 | or in, on, or within 1,000 feet of real property comprising a |
28 | state, county, or municipal park, a community center, or a |
29 | publicly owned recreational facility, the penalty shall be |
30 | reclassified as follows: |
31 | 1. A misdemeanor of the second degree is reclassified to a |
32 | misdemeanor of the first degree. |
33 | 2. A misdemeanor of the first degree is reclassified to a |
34 | felony of the third degree. |
35 | 3. A felony of the third degree is reclassified to a |
36 | felony of the second degree. |
