A bill to be entitled
2An act relating to voyeurism; amending s. 810.14, F.S.;
3revising the elements of the offense of voyeurism in order
4to eliminate acts of photographing, filming, videotaping,
5or recording, which are elements of the separate offense
6of video voyeurism; providing that a person commits the
7offense of voyeurism when he or she, with certain intent,
8secretly observes another person when the other person is
9in a location that provides a reasonable expectation of
10privacy; providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:

14     Section 1.  Section 810.14, Florida Statutes, is amended to
15read:
16     810.14  Voyeurism prohibited; penalties.--
17     (1)  A person commits the offense of voyeurism when he or
18she, with lewd, lascivious, or indecent intent, secretly
19observes, photographs, films, videotapes, or records another
20person when the such other person is located in a dwelling,
21structure, or conveyance and such location provides a reasonable
22expectation of privacy.
23     (2)  A person who violates this section commits a
24misdemeanor of the first degree for the first violation,
25punishable as provided in s. 775.082 or s. 775.083.
26     (3)  A person who violates this section and who has been
27previously convicted or adjudicated delinquent two or more times
28of any violation of this section commits a felony of the third
29degree, punishable as provided in s. 775.082, s. 775.083, or s.
30775.084.
31     (4)  For purposes of this section, a person has been
32previously convicted or adjudicated delinquent of a violation of
33this section if the violation resulted in a conviction sentenced
34separately, or an adjudication of delinquency entered
35separately, prior to the current offense.
36     Section 2.  This act shall take effect July 1, 2006.
