A bill to be entitled
2An act relating to sexual offenses; amending s. 810.14,
3F.S.; revising the elements of the offense of voyeurism in
4order to eliminate acts of photographing, filming,
5videotaping, or recording, which are elements of the
6separate offense of video voyeurism; providing that a
7person commits the offense of voyeurism when he or she,
8with certain intent, secretly observes another person when
9the other person is in a location that provides a
10reasonable expectation of privacy; providing an effective
11date.

13Be It Enacted by the Legislature of the State of Florida:

15     Section 1.  Section 810.14, Florida Statutes, is amended to
16read:
17     810.14  Voyeurism prohibited; penalties.--
18     (1)  A person commits the offense of voyeurism when he or
19she, with lewd, lascivious, or indecent intent, secretly
20observes, photographs, films, videotapes, or records another
21person when the such other person is located in a dwelling,
22structure, or conveyance and such location provides a reasonable
23expectation of privacy.
24     (2)  A person who violates this section commits a
25misdemeanor of the first degree for the first violation,
26punishable as provided in s. 775.082 or s. 775.083.
27     (3)  A person who violates this section and who has been
28previously convicted or adjudicated delinquent two or more times
29of any violation of this section commits a felony of the third
30degree, punishable as provided in s. 775.082, s. 775.083, or s.
31775.084.
32     (4)  For purposes of this section, a person has been
33previously convicted or adjudicated delinquent of a violation of
34this section if the violation resulted in a conviction sentenced
35separately, or an adjudication of delinquency entered
36separately, prior to the current offense.
37     Section 2.  This act shall take effect July 1, 2006.
