4     Amendment to Amendment (074037) (with title amendment)
5Remove lines 713-739 and insert:
6     (3)(a)(4)  Forty percent of the total appropriation in
7paragraph (2)(a) shall be used to inspect and improve tie-downs
8for mobile homes. Within 30 days after the effective date of
9that appropriation, the department shall contract with a public
10higher educational institution in this state which has previous
11experience in administering the programs set forth in this
12subsection to serve as the administrative entity and fiscal
13agent pursuant to s. 216.346 for the purpose of administering
14the programs set forth in this subsection in accordance with
15established policy and procedures. The administrative entity
16working with the advisory council set up under subsection (6)
17shall develop a list of mobile home parks and counties that may
18be eligible to participate in the tie-down program.
19     (b)1.  There is created the Manufactured Housing and Mobile
20Home Mitigation and Enhancement Program. The program shall
21require the mitigation of damage to or enhancement of homes for
22the areas of concern raised by the Department of Highway Safety
23and Motor Vehicles in the 2004-2005 Hurricane Reports on the
24effects of the 2004 and 2005 hurricanes on manufactured and
25mobile homes in this state. The mitigation of damage or
26enhancement of homes shall include, but not be limited to,
27structural components; site-built additions; or tie-down systems
28and may also address any other issues deemed appropriate by
29Tallahassee Community College, the Federation of Manufactured
30Home Owners of Florida, Inc., the Florida Manufactured Housing
31Association, and the Department of Highway Safety and Motor
32Vehicles. The program shall include an education and outreach
33component to ensure that owners of manufactured and mobile homes
34are aware of the benefits of participation.
35     2.  The program shall be a grant program that ensures
36entire manufactured home communities and mobile home parks may
37be improved wherever practicable. The moneys appropriated for
38this program shall be distributed directly to Tallahassee
39Community College for the uses set forth under this act.
40     3.  Upon evidence of completion of the program, the
41Citizens Property Insurance Corporation shall grant, on a pro
42rata basis, actuarially reasonable discounts, credits, or other
43rate differentials or appropriate reductions in deductibles for
44the properties of owners of manufactured homes or mobile homes
45on which fixtures or construction techniques that have been
46demonstrated to reduce the amount of loss in a windstorm have
47been installed or implemented. The discount on the premium shall
48be applied to subsequent renewal premium amounts. Premiums of
49the Citizens Property Insurance Corporation shall reflect the
50location of the home and the fact that the home has been
51installed in compliance with building codes adopted after
52Hurricane Andrew. Rates resulting from the completion of the
53Manufactured Housing and Mobile Home Mitigation and Enhancement
54Program are not considered competitive rates for the purposes of
55ss. 627.351(6)(d)1. and 2.
56     4.  On or before January 1 of each year, Tallahassee
57Community College shall provide a report of activities under
58this section to the Governor, the President of the Senate, and
59the Speaker of the House of Representatives. The report shall
60set forth the number of homes that have taken advantage of the
61program, the types of enhancements and improvements made to the
62manufactured or mobile homes and attachments to such homes, and
63whether there has been an increase of availability of insurance
64products to owners of manufactured homes or mobile homes.

66Tallahassee Community College shall develop the programs set
67forth in this subsection in consultation with the Federation of
68Manufactured Home Owners of Florida, Inc., the Florida
69Manufactured Housing Association, and the Department of Highway
70Safety and Motor Vehicles. The moneys appropriated for the
71programs set forth in this section shall be distributed directly
72to Tallahassee Community College for the uses set forth in this
73section.
74     (4)(5)  Of moneys provided to the Department of Community
75Affairs in paragraph (2)(a), 10 percent shall be allocated to a
76Type I Center within the State University System dedicated to
77hurricane research. The Type I Center shall develop a
78preliminary work plan approved by the advisory council set forth
79in subsection (5) (6) to eliminate the state and local barriers
80to upgrading existing mobile homes and communities, research and
81develop a program for the recycling of existing older mobile
82homes, and support programs of research and development relating
83to hurricane loss reduction devices and techniques for site-
84built residences. The State University System also shall consult
85with the Department of Community Affairs and assist the
86department with the report required under subsection (7) (8).
87     (5)(6)  Except for the programs set forth in subsection
88(3), the Department of Community Affairs shall develop

100consultation with certain entities; specifying

104to manufactured homes and mobile homes; specifying the
105program as a grant program for improvement of mobile homes
106and manufactured home parks; providing for distribution of
107the grants to Tallahassee Community College for certain
108purposes; requiring Citizens Property Insurance
109Corporation to grant certain insurance discounts, credits,
110rate differentials, or deductible reductions for property
111insurance premiums for manufactured home or mobile home
112owners; specifying criteria for such premiums; requiring a
113program report each year to the Governor and Legislature;
114providing report requirements; specifying funding for tie-
115down enhancement systems; requiring Tallahassee Community
116College to provide a program report each year to the
117Governor and Legislature; providing report requirements;
118creating s. 252.63, F.S.;
