6 | (d) Medicaid benefits.--When the Agency for Health Care |
7 | Administration provides, pays, or becomes liable for medical |
8 | assistance under the Medicaid program related to injury, |
9 | sickness, disease, or death arising out of the ownership, |
10 | maintenance, or use of a motor vehicle, benefits under ss. |
11 | 627.730-627.7405 shall be subject to the provisions of the |
12 | Medicaid program. |
13 | (e) In addition to the medical benefits contained in |
14 | subsection (1)(a), additional benefits for emergency services |
15 | and care, as defined in s. 395.002(10), of up to $10,000, are |
16 | available. Emergency services and care must be rendered in a |
17 | hospital by physicians in an emergency department, trauma center |
18 | or in-patient departments, when such services are determined by |
19 | the treating physician to be the result of a motor vehicle |
20 | accident. The additional emergency services and care benefit |
21 | must be rendered to the named insured, the named insured's |
22 | spouse, parents by blood or marriage, stepparents and |
23 | stepchildren, and children, natural or adopted, who reside in |
24 | the same household. Only emergency services and care rendered |
25 | pursuant to s. 395.002(10) or transport and treatment rendered |
26 | by an ambulance provider licensed pursuant to part III of |
27 | chapter 401 may be paid from the benefit. All such bills shall |
28 | be submitted on a UB 92 or CMS1500 form or their approved |
29 | successor forms. |
