| 5 | 2. If the insured fails to furnish the provider with the |
| 6 | correct name and address of the insured's personal injury |
| 7 | protection insurer, the provider has 75 days from the date the |
| 8 | provider obtains the correct information to furnish the insurer |
| 9 | with a statement of the charges. The insurer is not required to |
| 10 | pay for such charges unless the provider includes with the |
| 11 | statement documentary evidence that was provided by the insured |
| 12 | during the 75-day period demonstrating that the provider |
| 13 | reasonably relied on erroneous information from the insured or: |
| 14 | a. A denial letter from the incorrect insurer; or |
| 15 | b. Proof of mailing, which may include an affidavit under |
| 16 | penalty of perjury, reflecting timely mailing to the incorrect |
| 17 | address or insurer. |
