13         Senate Amendment (with title amendment) 
14         On page 6, between lines 27 and 28,
15  
16  insert:  
17         Section 3.  Subsection (5) of section 430.705, Florida
18  Statutes, is amended to read:
19         430.705  Implementation of the long-term care community
20  diversion pilot projects.--
21         (5)  A prospective participant who applies for the
22  long-term care community diversion project, who is determined
23  by the Comprehensive Assessment and Review for Long-Term-Care
24  (CARES) program to be medically eligible, and who has not been
25  determined financially eligible by the Department of Children
26  and Family Services shall be deemed as "Medicaid Pending." The
27  CARES program shall determine each applicant's eligibility
28  within 10 days after application. A contractor may provide
29  services to such individual until his or her financial
30  eligibility is determined. If the individual is determined
31  financially eligible, the agency shall pay the contractor who

If the 3 individual is not financially eligible for Medicaid, the 4 contractor may terminate services and seek reimbursement from 5 the individual. In order to achieve rapid enrollment into the 6 program and efficient diversion of applicants from nursing 7 home care, the department and the agency shall allow 8 enrollment of Medicaid beneficiaries on the date that 9 eligibility for the community diversion pilot project is 10 approved.
