3     Amendment (title amendment)
4     Between lines 152 and 153, insert:
5     Section 5.  Paragraph (b) of subsection (2) and subsection
6(6) of section 641.316, Florida Statutes, are amended to read:
7     641.316  Fiscal intermediary services.--
8     (2)
9     (b)  The term "fiscal intermediary services organization"
10means a person or entity that which performs fiduciary or fiscal
11intermediary services to health care professionals who contract
12with health maintenance organizations other than a fiscal
13intermediary services organization owned, operated, or
14controlled by a hospital licensed under chapter 395, an insurer
15licensed under chapter 624, a third-party administrator licensed
16under chapter 626, a prepaid limited health service organization
17licensed under chapter 636, a health maintenance organization
18licensed under this chapter, or physician group practices as
19defined in s. 456.053(3)(h) and providing services under the
20scope of licenses of the members of the group practice.
21     (6)  Any fiscal intermediary services organization, other
22than a fiscal intermediary services organization owned,
23operated, or controlled by a hospital licensed under chapter
24395, an insurer licensed under chapter 624, a third-party
25administrator licensed under chapter 626, a prepaid limited
26health service organization licensed under chapter 636, a health
27maintenance organization licensed under this chapter, or
28physician group practices as defined in s. 456.053(3)(h), and
29providing services under the scope of licenses of the members of
30the group practice, must register with the office and meet the
31requirements of this section. In order to register as a fiscal
32intermediary services organization, the organization must comply
33with ss. 641.21(1)(c), and (d), and (j), and 641.22(6), and
34641.27. The fiscal intermediary services organization must also
35comply with the provisions of ss. 641.3155, 641.3156, and
36641.51(4). Should the office determine that the fiscal
37intermediary services organization does not meet the
38requirements of this section, the registration shall be denied.
39In the event that the registrant fails to maintain compliance
40with the provisions of this section, the office may revoke or
41suspend the registration. In lieu of revocation or suspension of
42the registration, the office may levy an administrative penalty
43in accordance with s. 641.25.
