14         On page 20, line 31,

16  insert:  
17         Section 24.  Paragraph (d) of subsection (2) of section
18  794.055, Florida Statutes, is amended, present paragraphs (h)
19  and (i) of that subsection are redesignated as paragraphs (i)
20  and (j), respectively, a new paragraph (h) is added to that
21  subsection, and paragraphs (a) and (b) of subsection (3) of
22  that section are amended, to read:
23         794.055  Access to services for victims of sexual
24  battery.--
25         (2)  As used in this section, the term:
26         (d)  "Rape crisis center" means any public or private
27  agency that provides offers at least five of the sexual
28  battery recovery services in paragraph (g) to victims of
29  sexual battery and their families and is certified by the
30  statewide nonprofit association.
31         (h)  "Statewide nonprofit association" means the

Florida Senate - 2006 SENATOR AMENDMENT Bill No. CS for SB 826 Barcode 590132 1 federally recognized sexual assault coalition whose primary 2 purpose is to represent and provide technical assistance to 3 rape crisis centers. 4 (3)(a) The department shall contract with the a 5 statewide nonprofit association whose primary purpose is to 6 represent and provide technical assistance to rape crisis 7 centers. The statewide nonprofit This association shall 8 receive 95 percent of the moneys appropriated from the Rape 9 Crisis Program Trust Fund. 10 (b) Funds received under s. 938.085 shall be used to 11 provide sexual battery recovery services to victims and their 12 families. Funds shall be distributed to rape crisis centers by 13 county, based on an allocation formula that takes into account 14 the population and rural characteristics of each the county. 15 No more than 15 percent of the funds shall be used for 16 statewide initiatives, including developing service standards 17 and a certification process for rape crisis centers. No more 18 than 5 percent of the funds may be used for administrative 19 costs. 20 Section 25. Section 794.056, Florida Statutes, is 21 amended to read: 22 794.056 Rape Crisis Program Trust Fund.-- 23 (1) The Rape Crisis Program Trust Fund is created 24 within the Department of Health for the purpose of providing 25 funds for rape crisis centers in this state. Trust fund moneys 26 shall be used exclusively for the purpose of providing 27 services for victims of sexual assault. Funds credited to the 28 trust fund consist of those funds collected as an additional 29 court assessment in each case in which a defendant pleads 30 guilty or nolo contendere to, or is found guilty of, 31 regardless of adjudication, an offense defined in s. 784.011, 2 10:09 AM 05/02/06 s0826c1c-04-c2r
