19 population greater than 200,000, providing emergency power for
20 public special-needs hurricane evacuation shelters,
21 retrofitting public hurricane evacuation shelters, improving
22 logistical staging and warehouse capacity for commodities, and
23 planning for hurricane evacuations. The criteria in this
24 section shall be considered by the Legislature in determining
25 eligibility for funding.
26 (1)(a) The Legislature finds that emergency operations
27 centers located in a county or municipality having a
28 population greater than 200,000 should meet minimum criteria
29 for structural survivability and sufficiency of operational
30 space, as determined by assessments performed by the
31 Department of Community Affairs using the structural

1 requirements of American Red Cross Standard ARC 4496,
2 "Guidelines for Hurricane Evacuation Shelter Selection," and
3 based on guidance from the Federal Emergency Management
4 Agency. Criteria for prioritizing and recommending the funding
5 for emergency operations centers located in a county or
6 municipality having a population greater than 200,000 include,
7 but are not limited to, population, hurricane evacuation
8 clearance time for the vulnerable population, structural
9 survivability of the existing emergency operations center, and
10 guidance of the Federal Emergency Management Agency for
11 workspace requirements for the emergency operations center.
12 First priority for funding recommendations shall be for
13 emergency operations centers located in a county or
14 municipality having a population greater than 200,000 where no
15 survivable facility exists and where workspace deficits exist.
16 Funding recommendations made pursuant to this paragraph may
17 not include land acquisition; the purchase of equipment,
18 furnishings, communications, or operational systems; or
19 recurring expenditures. Funding recommendations must be
20 limited to the construction or structural renovation of the
21 emergency operations center located in a county or
22 municipality having a population greater than 200,000 needed
23 to meet the same structural requirements of American Red Cross
24 Standard ARC 4496, "Guidelines for Hurricane Evacuation
25 Shelter Selection," and national workspace recommendations.
26 The Department of Community Affairs shall establish a
27 statewide competitive grant application process for proposals
28 to construct or improve emergency operations centers located
29 in a county or municipality having a population greater than
30 200,000 such that those centers would, upon completion of the
31 project, meet minimum criteria as specified in this section.

1 The application may contain one or more independent proposals
2 for:
3 1. A construction or improvement project requesting
4 state financial assistance or having received state financial
5 assistance which also includes facility hardening or
6 mitigation and which qualifies for funding under the federal
7 Hazard Mitigation Grant Program. These proposals must document
8 the commitment of all local funds needed and identify the
9 proposed state and federal funding needed, based on the
10 funding criteria specified in this paragraph, to complete the
11 project for a fully operational emergency operations center
12 located in a county or municipality having a population
13 greater than 200,000.
14 2. A construction or improvement project to be funded
15 with local or other nonstate funds which includes facility
16 hardening or mitigation and which qualifies for funding under
17 the federal Hazard Mitigation Grant Program. These proposals
18 must document the commitment of all local funds needed and
19 identify the proposed federal funding needed, based on the
20 funding criteria in this paragraph, to complete the project
21 for a fully operational emergency operations center located in
22 a county or municipality having a population greater than
23 200,000.
24 (b) The department shall prioritize all properly
25 submitted project applications based on minimum criteria as
26 specified in this section, local government participation, and
27 documented need. In reviewing proposals, the department must
28 take into consideration all state funds already provided for
29 the project which have not been expended but which will
30 decrease the project's fiscal need once expended. The amount
31 of a project's cost recommended for funding by the department

1 shall be limited to those costs considered reasonably
2 necessary to meet minimum criteria specified in this section.
3 The release of any funds specifically appropriated to
4 implement this subsection must be approved by the Legislative
5 Budget Commission. Upon completion of the prioritization
6 process, and no later than November 1, 2006, the department
7 shall submit to the Legislative Budget Commission for approval
8 a comprehensive funding proposal for the construction of and
9 improvements to emergency operations centers located in a
10 county or municipality having a population greater than
11 200,000 using appropriated funds. The proposal submitted to
12 the Legislative Budget Commission must include a detailed
13 identification of the project and the corresponding detailed
14 local, state, and federal funding proposed for each project.
15 In order to ensure the maximum use of federal funds that are
16 available for the Hazard Mitigation Grant Program, any federal
17 funds appropriated to implement this subsection which remain
18 after fully allocating those funds to proposals under
19 subparagraphs 1. and 2. may be used to fund proposals for
20 retrofitting hurricane evacuation shelters under subsection
21 (3). Any federal funds appropriated to implement this
22 paragraph which remain after fully allocating those funds for
23 proposals under subparagraphs 1. and 2. and subsection (3)
24 shall be appropriated for distribution pursuant to chapter
25 9G-22, Florida Administrative Code. The Executive Office of
26 the Governor may submit a budget amendment to transfer those
27 funds in accordance with chapter 216, Florida Statutes.
28 (2) The Legislature finds that by June 1, 2007, all
29 designated public special-needs hurricane evacuation shelters
30 should be equipped with permanent emergency power generating
31 capacity in order to provide electrical power for necessary

1 medical equipment for persons housed in the shelter and for
2 heating, ventilating, and air-conditioning the facility. An
3 appropriation for equipping a public special-needs hurricane
4 evacuation shelter with permanent emergency power generating
5 capacity may also be used in coordination with local
6 communities in order to increase the number of special-needs
7 shelter spaces that are available and to ensure that a
8 sufficient number of public special-needs shelters are
9 designated to meet the anticipated demand based on the best
10 available data as determined jointly by the Department of
11 Community Affairs and the Department of Health.
12 (3) The Legislature finds that retrofitting public
13 hurricane evacuation shelters is an efficient and economical
14 method of accelerating the state and local efforts to reduce
15 the deficit in shelter space. Criteria for assessing and
16 prioritizing the funding needs for retrofitting public
17 hurricane evacuation shelters include, but are not limited to,
18 the project's ability to meet the structural and siting
19 requirements of American Red Cross Standard ARC 4496,
20 "Guidelines for Hurricane Evacuation Shelter Selection," once
21 completed; the shelter needs of the local government as well
22 as the overall needs of the hurricane evacuation planning
23 region; the cost-effectiveness of the project in terms of the
24 number of public hurricane evacuation spaces; and the priority
25 ranking of the proposed project in the applicable local
26 mitigation strategy. The Department of Community Affairs shall
27 establish a statewide competitive grant application process
28 for retrofitting public hurricane evacuation shelters to meet
29 the minimum criteria specified in this section. In reviewing
30 proposals, the department shall consider all state funds
31 already provided for the project which have not been expended

2 expended. The department shall prioritize all properly

4 this section and documented need. The release of any funds
5 specifically appropriated to implement this subsection must be
6 approved by the Legislative Budget Commission. Upon completion

20 (4) The Legislature finds that improved logistical
21 staging and warehouse capacity for commodities will help
22 ensure that adequate supplies, equipment, and commodities are
23 available and accessible for purposes of responding to
24 disasters. Appropriated funds may be used for increasing
25 storage capacity; improving technologies to manage
26 commodities; and enhancing the state's ability to maintain in
27 a safe and secure manner an inventory of supplies, equipment,
28 and commodities that would be needed in the immediate
29 aftermath of a disaster. The release of any funds specifically
30 appropriated to implement this subsection must be approved by
31 the Legislative Budget Commission. The department shall submit

1 a funding plan for improved logistical staging and warehouse
2 capacity to the Legislative Budget Commission for approval by
3 September 1, 2006. Procurement of technologies to perform
4 inventory tracking and commodities management must comply with
5 the provisions of s. 287.057, Florida Statutes, requiring
6 competitive bids.
7 (5) The Legislature finds that hurricane evacuation
8 planning is a critical task that must be completed in the most
9 effective and efficient manner possible. Appropriated funds
10 may be used to update current regional evacuation plans and
11 shall incorporate current transportation networks, behavioral
12 studies, and vulnerability studies. In addition, funds may be
13 used to perform computer-modeling analysis on the effects of
14 storm-surge events. Procurement of technologies to perform the
15 updates and computer modeling must comply with the provisions
16 s. 287.057, Florida Statutes, requiring competitive bids.
17 Section 2. The sum of $13.2 million in fixed capital
18 outlay is appropriated from the General Revenue Fund and the
19 sum of $39.6 million is appropriated from the U.S.
20 Contributions Trust Fund to the Department of Community
21 Affairs for the purpose of implementing the provisions of this
22 act relating to providing emergency power generators in
23 special-needs shelters during the 2006-2007 state
24 Section 3. The sum of $15 million in fixed capital
25 outlay is appropriated from the U.S. Contributions Trust Fund
26 to the Department of Community Affairs for the purpose of
27 implementing the provisions of this act relating to
28 retrofitting public hurricane evacuation shelters during the
29 2006-2007 state fiscal year. The Department of Community
30 Affairs may not use more than 5 percent of these funds to
31 administer the funding provided.

1 Section 4. The sum of $29 million is appropriated from
2 the U.S. Contributions Trust Fund to the Department of
3 Community Affairs for the purpose of implementing the
4 provisions of this act relating to hurricane evacuation
5 planning during the 2006-2007 state fiscal year. The
6 Department of Community Affairs may not use more than 5
7 percent of these funds to administer the funding provided.
8 Section 5. The sum of $2.1 million in recurring funds
9 is appropriated from the General Revenue Fund and the sum of
10 $4.4 million is appropriated from the Emergency Management
11 Preparedness and Assistance Trust Fund to the Department of
12 Community Affairs for the 2006-2007 state fiscal year.
13 Notwithstanding s. 252.373, Florida Statutes, these funds may
14 be used to implement the provisions of this act relating to
15 improved logistical staging and warehouse capacity for
16 commodities.
17 Section 6. The sum of $20 million in fixed capital
18 outlay is appropriated from the General Revenue Fund and the
19 sum of $25 million is appropriated from the U.S. Contributions
20 Trust Fund to the Department of Community Affairs for the
21 purpose of implementing the provisions of this act relating to
22 emergency operations centers located in a county or
23 municipality having a population greater than 200,000 during
24 the 2006-2007 state
