20 population greater than 200,000, providing emergency power for
21 public special-needs hurricane evacuation shelters,
22 retrofitting public hurricane evacuation shelters, improving
23 logistical staging and warehouse capacity for commodities, and
24 planning for hurricane evacuations. The criteria in this
25 section shall be considered by the Legislature in determining
26 eligibility for funding.
27 (1)(a) The Legislature finds that emergency operations
28 centers located in a county, or in a municipality having a
29 population greater than 200,000 should meet minimum criteria
30 for structural survivability and sufficiency of operational
31 space, as determined by assessments performed by the

1 Department of Community Affairs using the structural
2 requirements of American Red Cross Standard ARC 4496,
3 "Guidelines for Hurricane Evacuation Shelter Selection," and
4 based on guidance from the Federal Emergency Management
5 Agency. Criteria for prioritizing and recommending the funding
6 for emergency operations centers located in a county, or in a
7 municipality having a population greater than 200,000 include,
8 but are not limited to, population, hurricane evacuation
9 clearance time for the vulnerable population, structural
10 survivability of the existing emergency operations center, and
11 guidance of the Federal Emergency Management Agency for
12 workspace requirements for the emergency operations center.
13 First priority for funding recommendations shall be for
14 emergency operations centers located in a county, or in a
15 municipality having a population greater than 200,000 where no
16 survivable facility exists and where workspace deficits exist.
17 Funding recommendations made pursuant to this paragraph may
18 not include land acquisition; the purchase of equipment,
19 furnishings, communications, or operational systems; or
20 recurring expenditures. Funding recommendations must be
21 limited to the construction or structural renovation of the
22 emergency operations center located in a county, or in a
23 municipality having a population greater than 200,000 needed
24 to meet the same structural requirements of American Red Cross
25 Standard ARC 4496, "Guidelines for Hurricane Evacuation
26 Shelter Selection," and national workspace recommendations.
27 The Department of Community Affairs shall establish a
28 statewide competitive grant application process for proposals
29 to construct or improve emergency operations centers located
30 in a county, or in a municipality having a population greater
31 than 200,000 such that those centers would, upon completion of

1 the project, meet minimum criteria as specified in this
2 section. The application may contain one or more independent
3 proposals for:
4 1. A construction or improvement project requesting
5 state financial assistance or having received state financial
6 assistance which also includes facility hardening or
7 mitigation and which qualifies for funding under the federal
8 Hazard Mitigation Grant Program. These proposals must document
9 the commitment of all local funds needed and identify the
10 proposed state and federal funding needed, based on the
11 funding criteria specified in this paragraph, to complete the
12 project for a fully operational emergency operations center
13 located in a county, or in a municipality having a population
14 greater than 200,000.
15 2. A construction or improvement project to be funded
16 with local or other nonstate funds which includes facility
17 hardening or mitigation and which qualifies for funding under
18 the federal Hazard Mitigation Grant Program. These proposals
19 must document the commitment of all local funds needed and
20 identify the proposed federal funding needed, based on the
21 funding criteria in this paragraph, to complete the project
22 for a fully operational emergency operations center located in
23 a county, or in a municipality having a population greater
24 than 200,000.
25 (b) The department shall prioritize all properly
26 submitted project applications based on minimum criteria as
27 specified in this section, local government participation, and
28 documented need. In reviewing proposals, the department must
29 take into consideration all state funds already provided for
30 the project which have not been expended but which will
31 decrease the project's fiscal need once expended. The amount

1 of a project's cost recommended for funding by the department
2 shall be limited to those costs considered reasonably
3 necessary to meet minimum criteria specified in this section.
4 The release of any funds specifically appropriated to
5 implement this subsection must be approved by the Legislative
6 Budget Commission. Upon completion of the prioritization
7 process, and no later than November 1, 2006, the department
8 shall submit to the Legislative Budget Commission for approval
9 a comprehensive funding proposal for the construction of and
10 improvements to emergency operations centers located in a
11 county, or in a municipality having a population greater than
12 200,000 using appropriated funds. The proposal submitted to
13 the Legislative Budget Commission must include a detailed
14 identification of the project and the corresponding detailed
15 local, state, and federal funding proposed for each project.
16 In order to ensure the maximum use of federal funds that are
17 available for the Hazard Mitigation Grant Program, any federal
18 funds appropriated to implement this subsection which remain
19 after fully allocating those funds to proposals under
20 subparagraphs 1. and 2. may be used to fund proposals for
21 retrofitting hurricane evacuation shelters under subsection
22 (3). Any federal funds appropriated to implement this
23 paragraph which remain after fully allocating those funds for
24 proposals under subparagraphs 1. and 2. and subsection (3)
25 shall be appropriated for distribution pursuant to chapter
26 9G-22, Florida Administrative Code. The Executive Office of
27 the Governor may submit a budget amendment to transfer those
28 funds in accordance with chapter 216, Florida Statutes.
29 (2) The Legislature finds that by June 1, 2007, all
30 designated public special-needs hurricane evacuation shelters
31 should be equipped with permanent emergency power generating

1 capacity in order to provide electrical power for necessary
2 medical equipment for persons housed in the shelter and for
3 heating, ventilating, and air-conditioning the facility. An
4 appropriation for equipping a public special-needs hurricane
5 evacuation shelter with permanent emergency power generating
6 capacity may also be used in coordination with local
7 communities in order to increase the number of special-needs
8 shelter spaces that are available and to ensure that a
9 sufficient number of public special-needs shelters are
10 designated to meet the anticipated demand based on the best
11 available data as determined jointly by the Department of
12 Community Affairs and the Department of Health.
13 (3) The Legislature finds that retrofitting public
14 hurricane evacuation shelters is an efficient and economical
15 method of accelerating the state and local efforts to reduce
16 the deficit in shelter space. Criteria for assessing and
17 prioritizing the funding needs for retrofitting public
18 hurricane evacuation shelters include, but are not limited to,
19 the project's ability to meet the structural and siting
20 requirements of American Red Cross Standard ARC 4496,
21 "Guidelines for Hurricane Evacuation Shelter Selection," once
22 completed; the shelter needs of the local government as well
23 as the overall needs of the hurricane evacuation planning
24 region; the cost-effectiveness of the project in terms of the
25 number of public hurricane evacuation spaces; and the priority
26 ranking of the proposed project in the applicable local
27 mitigation strategy. The Department of Community Affairs shall
28 establish a statewide competitive grant application process
29 for retrofitting public hurricane evacuation shelters to meet
30 the minimum criteria specified in this section. In reviewing
31 proposals, the department shall consider all state funds

1 already provided for the project which have not been expended
2 but which will decrease the project's fiscal need once
3 expended. The department shall prioritize all properly

5 this section and documented need. The release of any funds
6 specifically appropriated to implement this subsection must be
7 approved by the Legislative Budget Commission. Upon completion

19 accordance with the provisions of chapter 216, Florida
20 Statutes.
21 (4) The Legislature finds that improved logistical
22 staging and warehouse capacity for commodities will help
23 ensure that adequate supplies, equipment, and commodities are
24 available and accessible for purposes of responding to
25 disasters. Appropriated funds may be used for increasing
26 storage capacity; improving technologies to manage
27 commodities; and enhancing the state's ability to maintain in
28 a safe and secure manner an inventory of supplies, equipment,
29 and commodities that would be needed in the immediate
30 aftermath of a disaster. The release of any funds specifically
31 appropriated to implement this subsection must be approved by

1 the Legislative Budget Commission. The department shall submit
2 a funding plan for improved logistical staging and warehouse
3 capacity to the Legislative Budget Commission for approval by
4 September 1, 2006. Procurement of technologies to perform
5 inventory tracking and commodities management must comply with
6 the provisions of s. 287.057, Florida Statutes, requiring
7 competitive bids.
8 (5) The Legislature finds that hurricane evacuation
9 planning is a critical task that must be completed in the most
10 effective and efficient manner possible. Appropriated funds
11 may be used to update current regional evacuation plans and
12 shall incorporate current transportation networks, behavioral
13 studies, and vulnerability studies. In addition, funds may be
14 used to perform computer-modeling analysis on the effects of
15 storm-surge events. Procurement of technologies to perform the
16 updates and computer modeling must comply with the provisions
17 s. 287.057, Florida Statutes, requiring competitive bids.
18 Section 2. The sum of $13.2 million in fixed capital
19 outlay is appropriated from the General Revenue Fund and the
20 sum of $39.6 million is appropriated from the U.S.
21 Contributions Trust Fund to the Department of Community
22 Affairs for the purpose of implementing the provisions of this
23 act relating to providing emergency power generators in
24 special-needs shelters during the 2006-2007 state fiscal year.
25 The Department of Community Affairs may not use more than 5
26 percent of these funds to administer the funding provided.
27 Section 3. The sum of $15 million in fixed capital
28 outlay is appropriated from the U.S. Contributions Trust Fund
29 to the Department of Community Affairs for the purpose of
30 implementing the provisions of this act relating to
31 retrofitting public hurricane evacuation shelters during the

1 2006-2007 state fiscal year. The Department of Community
2 Affairs may not use more than 5 percent of these funds to
3 administer the funding provided.
4 Section 4. The sum of $29 million is appropriated from
5 the U.S. Contributions Trust Fund to the Department of
6 Community Affairs for the purpose of implementing the
7 provisions of this act relating to hurricane evacuation
8 planning during the 2006-2007 state fiscal year. The
9 Department of Community Affairs may not use more than 5
10 percent of these funds to administer the funding provided.
11 Section 5. The sum of $2.1 million in recurring funds
12 is appropriated from the General Revenue Fund and the sum of
13 $4.4 million is appropriated from the Emergency Management
14 Preparedness and Assistance Trust Fund to the Department of
15 Community Affairs for the 2006-2007 state fiscal year.
16 Notwithstanding s. 252.373, Florida Statutes, these funds may
17 be used to implement the provisions of this act relating to
18 improved logistical staging and warehouse capacity for
19 commodities.
20 Section 6. The sum of $20 million in fixed capital
21 outlay is appropriated from the General Revenue Fund and the
22 sum of $25 million is appropriated from the U.S. Contributions
23 Trust Fund to the Department of Community Affairs for the
24 purpose of implementing the provisions of this act relating to
25 emergency operations centers located in a county, or in a
26 municipality having a population greater than 200,000 during
27 the 2006-2007 state
