A bill to be entitled
2An act relating to impact of slot machine gaming; creating
3s. 551.1062, F.S.; requiring an annual fee to be
4established by the Division of Pari-mutuel Wagering and
5collected from slot machine gaming facilities to mitigate
6the impact of slot machine gaming on neighboring
7municipalities; defining "neighboring municipality";
8providing for the use of the revenue collected; providing
9procedures for collection and distribution by the division
10to neighboring municipalities; providing an effective
11date.

13Be It Enacted by the Legislature of the State of Florida:

15     Section 1.  Section 551.1062, Florida Statutes, is created
16to read:
17     551.1062  Mitigation of impact; fee.--An annual fee not to
18exceed $1,000, established by the division, is imposed upon each
19slot machine approved for use at any eligible facility that is
20within 1 mile of any neighboring municipality. As used in this
21section, the term "neighboring municipality" means a
22municipality that does not have an eligible facility but is
23adjacent to an eligible facility and will have public safety,
24police, and fire and rescue impacts that are demonstrated by
25significant increased aid calls to affected municipalities that
26are not currently funded. Revenue from the fees imposed by this
27section must be used by the neighboring municipality to fund the
28adverse public health, safety, and welfare and public works and
29traffic impacts that will be caused by the implementation of s.
3023, Art. X of the State Constitution and that will occur as a
31direct result of slot machine operations. Each year, the fee
32shall be remitted to the division to be deposited into the Pari-
33mutuel Wagering Trust Fund and distributed to any neighboring
34municipality that has provided evidence to the division of
35significant local impacts from slot machine operations during
36the prior year. Criteria for significant local impacts under
37this section shall be established by the division by rule
38pursuant to ss. 120.536(1) and 120.54 but shall include
39increased crime incident reports, fire and rescue and emergency
40medical incident reports, and traffic flow and infrastructure
41impacts. The fee must be remitted by February 1 of each year
42based on the number of slot machines approved for operation by
43the division as of January 1. The funds shall be designated by
44the division on a pro rata basis to the affected neighboring
45municipalities.
46     Section 2.  This act shall take effect July 1, 2006.
