1 A bill to be entitled
2 An act relating to pediatric skilled nursing
3 facilities; providing a definition; requiring
4 the Agency for Health Care Administration to
5 implement a program and develop criteria for
6 designation as a licensed pediatric skilled
7 nursing facility; requiring that certain
8 affiliations be established and providing
9 purposes thereof; providing criteria for a
10 nursing home to qualify as a licensed pediatric
11 skilled nursing facility; prohibiting
12 expenditure of certain funds for certain
13 purposes; providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:
16
17 Section 1. Implementation of a pediatric skilled
18 nursing facility license.--
19 (1) As used in this section, the term "pediatric
20 skilled nursing facility" means a nursing home that contains a
21 maximum of 36 licensed nursing home beds; has access to a
22 resident pediatric and young adult population of sufficient
23 size to support resident education, socialization, and
24 rehabilitation; and has a contractual relationship with the
25 Department of Education in this state.
26 (2)(a) The Agency for Health Care Administration shall
27 implement a comprehensive multidisciplinary program of
28 education and rehabilitation in a nursing home facility
29 designated by the agency as a licensed pediatric skilled
30 nursing facility. The program shall be administered at the
31 nursing home facility and in other appropriate settings.

1 (b) The agency shall develop criteria for designating
2 licensed pediatric skilled nursing facilities in consultation
3 with advocates of children and advocates of persons with
4 disabilities.
5 (3) To be designated as a licensed pediatric skilled
6 nursing facility, a nursing home licensee shall, at a minimum:
7 (a) Provide a comprehensive program of integrated
8 pediatric services that include institutional and
9 community-based services.
10 (b) Participate in a nationally recognized
11 accreditation program and hold a valid accreditation, such as
12 the accreditation awarded by the Joint Commission on
13 Accreditation of Healthcare Organizations or the Commission of
14 Accreditation of Rehabilitative Facilities.
15 (c) Have been in business in this state for a minimum
16 of 10 consecutive years.
17 (d) Demonstrate an active program in multidisciplinary
18 education and rehabilitation that relates to medically fragile
19 children.
20 (e) Have a formalized contractual relationship with at
21 least one accredited health profession education program
22 located in this state.
23 (f) Have a formalized relationship with an accredited
24 hospital.
25 (g) Have senior consultants and staff members who hold
26 formal faculty appointments at universities, at least one of
27 which has an accredited health profession education program.
28 (4) A licensed pediatric skilled nursing facility
29 shall be affiliated with the Department of Education and
30 national organizations focused on excellence in pediatric
31 nursing care and education. The purpose of such affiliations

1 is to foster the development of methods for improving and
2 expanding the capability of health care facilities to respond
3 to the medical, psychological, and social needs of
4 technologically dependent and medically fragile infants,
5 children, and young adults by providing the most effective and
6 appropriate services. A licensed pediatric skilled nursing
7 facility shall serve as a resource for education and the
8 dissemination of best practices in the provision of health
9 care services in institutional settings to the pediatric and
10 young adult populations with special health care needs.
11 (5) In order for a nursing home to qualify as a
12 licensed pediatric skilled nursing facility and to be entitled
13 to the benefits provided under this section, the nursing home
14 shall:
15 (a) Be primarily operated and established to offer,
16 afford, and render a comprehensive multidisciplinary program
17 for medically fragile children and young adults. This program
18 shall provide education, socialization, rehabilitation,
19 counseling, recreation, daily living, and assistive technology
20 services and equipment to encourage independence and maximize
21 quality-of-life potential to residents of the state.
22 (b) Certify to the Agency for Health Care
23 Administration each school year the name, address, and
24 educational history of each resident approved and accepted for
25 admission to the facility.
26 (6) If a licensed pediatric skilled nursing facility
27 receives funds appropriated to administer this section, it may
28 not expend the funds for:
29 (a) Any purpose other than operating and maintaining a
30 pediatric skilled nursing facility and conducting pediatric
31 education and rehabilitation;

1 (b) Constructing any building of any kind, nature, or
2 description; or
3 (c) Maintaining or operating, in any form or manner, a
4 nonlicensed pediatric skilled nursing facility or health care
5 facility.
6 Section 2. This act shall take effect upon becoming a
7 law.
