2 An act relating to Medicaid services; amending
3 s. 409.905, F.S.; increasing the Medicaid
4 reimbursement rates for air ambulance
5 transportation to match the Medicare rates;
6 providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (12) of section 409.905, Florida
11 Statutes, is amended to read:
12 409.905 Mandatory Medicaid services.--The agency may
13 make payments for the following services, which are required
14 of the state by Title XIX of the Social Security Act,
15 furnished by Medicaid providers to recipients who are
16 determined to be eligible on the dates on which the services
17 were provided. Any service under this section shall be
18 provided only when medically necessary and in accordance with
19 state and federal law. Mandatory services rendered by
20 providers in mobile units to Medicaid recipients may be
21 restricted by the agency. Nothing in this section shall be
22 construed to prevent or limit the agency from adjusting fees,
23 reimbursement rates, lengths of stay, number of visits, number
24 of services, or any other adjustments necessary to comply with
25 the availability of moneys and any limitations or directions
26 provided for in the General Appropriations Act or chapter 216.
27 (12) TRANSPORTATION SERVICES.--The agency shall ensure
28 that appropriate transportation services are available for a
29 Medicaid recipient in need of transport to a qualified
30 Medicaid provider for medically necessary and
31 Medicaid-compensable services, provided a client's ability to

1 choose a specific transportation provider shall be limited to
2 those options resulting from policies established by the
3 agency to meet the fiscal limitations of the General
4 Appropriations Act. The agency may pay for transportation and
5 other related travel expenses as necessary only if these
6 services are not otherwise available. Medicaid reimbursement
7 for air ambulance transportation shall be paid at the same
8 rates as current Medicare reimbursement for the same services.
9 Section 2. This act shall take effect upon becoming a
10 law.
