3     Amendment to Amendment (413029) (with title amendment)
4Remove lines 261-311 and insert:
5     Section 8.  Florida Energy Commission.--
6     (1)  The Florida Energy Commission is created and shall be
7located within the Office of Legislative Services for
8administrative purposes. The commission shall be comprised of a
9total of nine members.
10     (a)  The members shall be appointed as follows: the
11President of the Senate and the Speaker of the House of
12Representatives shall appoint four members each and shall
13jointly appoint the ninth member, who shall serve as chair.
14Members shall be appointed to 2-year terms; however, in order to
15establish staggered terms, for the initial appointments, each
16appointing official shall appoint two members to a 1-year term
17and two members to a 2-year term. Members must meet the
18following qualifications and restrictions:
19     1.  A member must be an expert in one or more of the
20following fields: energy, natural resource conservation,
21economics, engineering, finance, law, consumer protection, state
22energy policy, or another field substantially related to the
23duties and functions of the commission. The commission shall
24fairly represent the fields specified in this subparagraph.
25     2.  Each member shall, at the time of appointment and at
26each commission meeting during his or her term of office,
27disclose:
28     a.  Whether he or she has any financial interest, other
29than ownership of shares in a mutual fund, in any business
30entity that, directly or indirectly, owns or controls, or is an
31affiliate or subsidiary of, any business entity that may profit
32by the policy recommendations developed by the commission.
33     b.  Whether he or she is employed by or is engaged in any
34business activity with any business entity that, directly or
35indirectly, owns or controls, or is an affiliate or subsidiary
36of, any business entity that may profit by the policy
37recommendations developed by the commission.
38     (b)  The following may also attend meetings and provide
39information and advise at the request of the chair:
40     1.  The chair of the Florida Public Service Commission, or
41his or her designee.
42     2.  The Public Counsel, or his or her designee.
43     3.  The Commissioner of Agriculture, or his or her
44designee.
45     4.  The Director of the Office of Insurance Regulation, or
46his or her designee.
47     5.  The Secretary of Health, or his or her designee.
48     6.  The chair of the State Board of Education, or his or
49her designee.
50     7.  The Secretary of Community Affairs, or his or her
51designee.
52     8.  The Secretary of Transportation, or his or her
53designee.
54     9.  The Secretary of Environmental Protection, or his or
55her designee.
56     (2)  Members shall serve without compensation but are
57entitled to reimbursement for per diem and travel expenses as
58provided in s. 112.061, Florida Statutes.
59     (3)  Meetings of the commission shall be held in various
60locations around the state and at the call of the chair;
61however, the commission must meet at least twice each year.
62     (4)(a)  The commission may employ staff to assist in the
63performance of its duties, including an executive director, an
64attorney, a communications staff member, and an executive
65assistant.
66     (b)  The commission may form advisory groups consisting of
67members of the public to provide information on specific issues.
68     (5)  The commission shall develop recommendations for
69legislation to establish a state energy policy. The
70recommendations of the commission shall be based on the guiding
71principles of reliability, efficiency, affordability, and
72diversity as provided in subsection (7). The commission shall
73continually review the state energy policy and shall recommend
74to the Legislature any additional necessary changes or
75improvements.
76     (6)(a)  The commission shall report by December 31 of each
77year to the President of the Senate and the Speaker of the House
78of Representatives on its progress and recommendations,
79including draft legislation.
80     (b)  The commission's initial report must be filed by
81December 31, 2007, and must identify incentives for research,
82development, or deployment projects involving the goals and
83issues set forth in this section; set forth policy
84recommendations for conservation of all forms of energy; and set
85forth a plan of action, together with a timetable, for
86addressing additional issues.
87     (c)  The commission's initial report shall also recommend
88consensus-based public-involvement processes that evaluate
89greenhouse gas emissions in this state and make recommendations
90regarding related economic, energy, and environmental benefits.
91     (d)  The report must include recommended steps and a
92schedule for the development of a comprehensive state climate
93action plan with greenhouse gas reduction through a public-
94involvement process, including transportation and land use;
95power generation; residential, commercial, and industrial
96activities; waste management; agriculture and forestry;
97emissions-reporting systems; and public education.
98     (7)  In developing its recommendations, the commission
99shall be guided by the principles of reliability, efficiency,
100affordability, and diversity, and more specifically as follows:
101     (a)  The state should have a reliable electric supply with
102adequate reserves.
103     (b)  The transmission and delivery of electricity should be
104reliable.
105     (c)  The generation, transmission, and delivery of
106electricity should be accomplished with the least detriment to
107the environment and public health.
108     (d)  The generation, transmission, and delivery of
109electricity should be accomplished compatibly with the goals for
110growth management.
111     (e)  Electricity generation, transmission, and delivery
112facilities should be reasonably secure from damage, taking all
113factors into consideration, and recovery from damage should be
114prompt.
115     (f)  Electric rates should be affordable, as to base rates
116and all recovery-clause additions, with sufficient incentives
117for utilities to achieve this goal.
118     (g)  The state should have a reliable supply of motor
119vehicle fuels, both under normal circumstances and during
120hurricanes and other emergency situations.
121     (h)  In-state research, development, and deployment of
122alternative energy technologies and alternative motor vehicle
123fuels should be encouraged.
124     (i)  When possible, the resources of the state should be
125used in achieving the goals enumerated in this subsection.
126     (j)  Consumers of energy should be encouraged and given
127incentives to be more efficient in their use of energy.

129It is the specific intent of the Legislature that nothing in
130this section shall in any way change the powers, duties, and
131responsibilities of the Public Service Commission or the powers,
132duties, and responsibilities assigned by the Florida Electrical
133Power Plant Siting Act, ss. 403.501-403.518, Florida Statutes.
