11 The Committee on Ways and Means (Atwater) recommended the
12 following amendment:

15 On page 25, lines 21-30, delete those lines
16
17 and insert:
18 Section 3. (1) The Florida Public Service Commission
19 shall direct a study of the electric transmission grid in the
20 state. The study shall look at electric system reliability to
21 examine the efficiency and reliability of power transfer and
22 emergency contingency conditions. In addition, the study shall
23 examine the hardening of infrastructure to address issues
24 arising from the 2004 and 2005 hurricane seasons. A report of
25 the results of the study shall be provided to the Governor,
26 the President of the Senate, and the Speaker of the House of
27 Representatives by March 1, 2007.
28 (2) The Commission shall conduct a review to determine
29 what should be done to enhance the reliability of Florida's
30 transmission and distribution grids during extreme weather
31 events, including the strengthening of distribution and

1 transmission facilities. Considerations may include:
2 (a) Recommendations for promoting and encouraging
3 underground electric distribution for new service/construction
4 provided by public utilities.
5 (b) Recommendations for promoting and encouraging the
6 conversion of existing overhead distribution facilities to
7 underground facilities, including any recommended incentives
8 to local governments for local government sponsored
9 conversions.
10 (c) Recommendations as to whether incentives for local
11 government sponsored conversions should include participation
12 by a public utility in the conversion costs as an investment
13 in the reliability of the grid in total, with such investment
14 recognized as new plant in service for regulatory purposes.
15 (d) Recommendations for promoting and encouraging the
16 use of road rights-of-way for the location of underground
17 facilities in any local government sponsored conversion
18 project, provided the customers of the public utility do not
19 incur increased liability and future relocation costs.
20 (3) This section does not limit the existing
21 jurisdiction or powers of the commission. It may not be
22 construed to delay or defer any activities that are currently
23 docketed which relate to matters to be addressed by the study
24 required by this section, nor may it be construed to delay or
25 defer any case or proceeding that may be initiated before the
26 commission pursuant to current statutory powers of the
27 commission.
