15 On page 32, after line 31,

17 insert:
18 377.8055 Energy-efficient products sales tax
19 holiday.--
20 (1) The period from 12:01 a.m., October 5, through
21 midnight, October 11, in each year from 2006 to 2009, shall be
22 designated "Energy Efficiency Week," and the tax levied under
23 chapter 212 may not be collected on the sale of a new
24 energy-efficient product having a selling price of $1,500 or
25 less per product during that period. As used in this
26 subsection, the term "energy-efficient product" means a
27 dishwasher, clothes washer, air conditioner, ceiling fan,
28 incandescent or florescent light bulb, dehumidifier,
29 programmable thermostat, or refrigerator that has been
30 designated by the United States Environmental Protection
31 Agency and by the United States Department of Energy as

1 meeting or exceeding each agency's requirements for energy
2 efficiency under the Energy Star Program of either agency.
3 (2)(a) The exemption in this section applies only when
4 the energy-efficient product is purchased for noncommercial
5 home or personal use and does not apply when the product is
6 purchased for trade, business, or resale.
7 (b) Purchases made under this section may not be made
8 using a business or company credit or debit card or check.
9 (c) Any construction company, building contractor, or
10 commercial business or entity that purchases or attempts to
11 purchase the energy-efficient products exempt as provided in
12 this section commits an unfair method of competition in
13 violation of s. 501.204, Florida Statutes, punishable as
14 provided in s. 501.2075, Florida Statutes.
15 (3) The Department of Revenue may adopt rules pursuant
16 to ss. 120.536(1) and 120.54, Florida Statutes, to administer
17 this section.
