  1                      A bill to be entitled

  2         An act relating to state travel expenses;

  3         amending s. 112.061, F.S.; prescribing an

  4         alternative rate for calculating mileage

  5         reimbursement when privately owned vehicles are

  6         used for official travel by certain state

  7         employees; providing an effective date.

  8  

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Paragraph (d) of subsection (7) of section

12  112.061, Florida Statutes, is amended to read:

13         112.061  Per diem and travel expenses of public

14  officers, employees, and authorized persons.--

15         (7)  TRANSPORTATION.--

16         (d)1.  The use of privately owned vehicles for official

17  travel in lieu of publicly owned vehicles or common carriers

18  may be authorized by the agency head or his or her designee.

19  Whenever travel is by privately owned vehicle, the traveler

20  shall be entitled to a mileage allowance at a fixed rate of 25

21  cents per mile for state fiscal year 1994-1995 and 29 cents

22  per mile thereafter or the common carrier fare for such

23  travel, as determined by the agency head. However, when travel

24  is by privately owned vehicle and the traveler is a state

25  correctional probation officer, as defined in s. 943.10, who

26  is engaged in a law enforcement or correctional duty, the

27  officer is entitled to a mileage allowance equal to the

28  business standard mileage rate set by the United States

29  Internal Revenue Service for the calendar year in which the

30  official travel occurs. Reimbursement for expenditures related

31  to the operation, maintenance, and ownership of a vehicle

 1  shall not be allowed when privately owned vehicles are used on

 2  public business and reimbursement is made pursuant to this

 3  paragraph, except as provided in subsection (8).

 4         2.  All mileage shall be shown from point of origin to

 5  point of destination and, when possible, shall be computed on

 6  the basis of the current map of the Department of

 7  Transportation. Vicinity mileage necessary for the conduct of

 8  official business is allowable but must be shown as a separate

 9  item on the expense voucher.

10         Section 2.  This act shall take effect July 1, 2006.

13                          SENATE SUMMARY

14    Provides for a state correctional probation officer who
      uses a privately owned vehicle for official duty to be
15    reimbursed for mileage in an amount equal to the rate set
      by the United States Internal Revenue Service.
