15         On page 2, line 11-18, delete those lines

17  and insert:  
18         4.  A facility of a common carrier which is subject, in
19  whole or in part, to the provisions of 47 U.S.C. ss. 201, et.
20  seq., except that such facility shall be considered a cable
21  system to the extent that such facility is used in the
22  transmission of video programming directly to subscribers,
23  unless the extent of such use is solely to provide interactive
24  on-demand services.
