7An act relating to transportation concurrency management;
8amending s. 163.3180, F.S.; providing an exception to
9certain in-place or under-actual-construction requirements
10for transportation facilities serving new developments for
11certain stricter concurrency requirements by local
12governments; providing an effective date.

14Be It Enacted by the Legislature of the State of Florida:
15
16     Section 1.  Paragraph (c) of subsection (2) of section
17163.3180, Florida Statutes, is amended to read:
18     163.3180  Concurrency.--
19     (2)
20     (c)  Consistent with the public welfare, and except as
21otherwise provided in this section, transportation facilities
22needed to serve new development shall be in place or under
23actual construction within 3 years after the local government
24approves a building permit or its functional equivalent that
25results in traffic generation. Nothing is this section prohibits
26a local government that has adopted a stricter concurrency
27management system prior to the enactment of chapter 2005-290,
28Laws of Florida, that provides for a shorter time period than 3
29years from using a stricter concurrency management system and
30requirements under which a local government need not issue a
31building permit or its functional equivalent under any
32circumstances that result in traffic generation until adequate
33transportation facilities are in place pursuant to the local
34government's adopted concurrency management system.
35     Section 2.  This act shall take effect July 1, 2006.
