A bill to be entitled
2An act relating to the Troup-Indiantown Water Control
3District, Martin County; amending chapter 2002-366, Laws
4of Florida; correcting the legal description of the
5boundaries of the district; revising requirements for
6membership on the board of supervisors; clarifying
7applicability of general law; providing an effective date.

9Be It Enacted by the Legislature of the State of Florida:
10
11     Section 1.  Section 1 of section 1 of chapter 2002-366,
12Laws of Florida, is amended to read:
13     Section 1.  Status and boundaries of Troup-Indiantown Water
14Control District.--The Troup-Indiantown Water Control District
15is hereby declared to be an independent water control district
16and a public corporation of the State of Florida pursuant to
17chapter 298, Florida Statutes, as it may be amended from time to
18time, and the lands lying within the area described as follows
19in Martin County, Florida, shall hereby constitute the Troup-
20Indiantown Water Control District:

22Beginning at the southeast corner of Section 28 33,
23Township 39 South, Range 39 East, run thence East with
24the South line of Section 27 34 a distance of 60 feet
25to a point; run thence North on a line 60 feet East of
26and parallel to the East lines of Sections 33, 28, 21
27and 16 to a point in the North line of Section 15
28which is 60 feet East of the Northwest corner of said
29Section 15; run thence in a straight line to the
30Northeast corner of Section 9; run thence North

110     Section 2.  Subsection (4) of section 2 of section 1 of
111chapter 2002-366, Laws of Florida, is amended to read:
112     Section 2.  Minimum charter requirements.--In accordance
113with section 189.404(3), Florida Statutes, the following
114subsections shall constitute the charter of the Troup-Indiantown
115Water Control District:
116     (4)  In accordance with this act and chapters chapter 189
117and 298, Florida Statutes, to the extent not inconsistent with
118this act, and section 298.11, Florida Statutes, the district is
119governed by a three-member board, elected on a one-acre, one-
120vote basis by the landowners landowner in the district; however,
121landowners owning less than one acre shall be entitled to one
122vote. Landowners with more than one acre shall be entitled to
123one additional vote for any fraction of an acre greater than 1/2
124acre owned, when all of the landowner's acreage has been
125aggregated for purposes of voting. Notwithstanding s. 298.11(1),
126Florida Statutes, members of the board of supervisors do not
127have to be owners of lands in the district and residents of the
128county or counties in which the district is located but must be
129residents of the State of Florida and citizens of the United
130States. The membership and organization of the board shall be as
131set forth in this act and chapter 298, Florida Statutes, as they
132may be amended from time to time, provided this act controls
133with respect to any inconsistency.
134     Section 3.  This act shall take effect upon becoming a law.
