  1                      A bill to be entitled

  2         An act relating to optional Medicaid payments;

  3         amending s. 409.904, F.S.; increasing the

  4         monthly personal allowance for certain eligible

  5         persons; providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8  

  9         Section 1.  Paragraph (a) of subsection (3) of section

10  409.904, Florida Statutes, is amended to read:

11         409.904  Optional payments for eligible persons.--The

12  agency may make payments for medical assistance and related

13  services on behalf of the following persons who are determined

14  to be eligible subject to the income, assets, and categorical

15  eligibility tests set forth in federal and state law. Payment

16  on behalf of these Medicaid eligible persons is subject to the

17  availability of moneys and any limitations established by the

18  General Appropriations Act or chapter 216.

19         (3)  A person who is in need of the services of a

20  licensed nursing facility, a licensed intermediate care

21  facility for the developmentally disabled, or a state mental

22  hospital, whose income does not exceed 300 percent of the SSI

23  income standard, and who meets the assets standards

24  established under federal and state law. In determining the

25  person's responsibility for the cost of care, the following

26  amounts must be deducted from the person's income:

27         (a)  The monthly personal allowance for residents which

28  shall be $45 per month as set based on appropriations.

29         Section 2.  This act shall take effect July 1, 2006.
