A bill to be entitled
2An act relating to temporary buildings; amending s.
3553.37, F.S.; authorizing certain temporary buildings to
4be permitted to use certain foundation systems; providing
5for extending the time period of use of such buildings
6under certain circumstances; prohibiting denial of an
7extension application under certain circumstances;
8specifying nonapplication to certain structures; requiring
9the Florida Building Commission to define certain terms
10and provide certain standards and criteria within the
11Florida Building Code for temporary structures or
12buildings; requiring the commission to adopt such
13standards and criteria by a specified time; providing an
14effective date.

16Be It Enacted by the Legislature of the State of Florida:

18     Section 1.  Subsection (12) is added to section 553.37,
19Florida Statutes, to read:
20     553.37  Rules; inspections; and insignia.--
21     (12)  A manufactured building that otherwise complies with
22this part and is intended to be used for 2 years or less shall
23be permitted to use a foundation system designed and installed
24in accordance with the standards adopted pursuant to s.
25320.8325(1). Use of the building shall be extended for an
26additional 2 years upon application to the authority having
27jurisdiction and an inspection of the foundation system to
28determine the system's integrity and ability to perform. An
29application for an extension may not be denied without a
30complete inspection and verified findings of fault with the
31foundation system. This subsection does not apply to a
32residential manufactured building or factory-built school.
33     Section 2.  The Florida Building Commission shall define
34within the Florida Building Code the terms "temporary
35manufactured structures" and "temporary manufactured buildings"
36as structures and buildings that are used for a period of 2
37years or less. The commission shall also provide within the
38Florida Building Code standards and criteria for installation of
39temporary buildings and structures that account for their
40temporary use and that ensure the safety of occupants, the cost
41of the foundation designs, and the integrity of the building's
42installation. The standards and criteria shall not discriminate
43against materials, products, methods, and systems of
44construction of demonstrated capabilities. The commission shall
45also develop criteria for a 2-year extension of the period of
46time that a temporary structure or building can be used upon
47application of the possessor of the structure or building and
48inspection by the authority having jurisdiction. The commission
49shall adopt these standards and criteria into the Florida
50Building Code, and the standards shall take effect not later
51than July 1, 2008.
52     Section 3.  This act shall take effect upon becoming a law.
